How do you obtain a permit for industrial waste collection and transport? Disqualifications, the course and depot requirements

To collect and transport another party's industrial waste as a business, you need a prefectural governor's permit under Article 14 of the Waste Management Act. In short: to collect and transport "another party's industrial waste" as a business (repeatedly and continuously) — waste arising from construction, demolition, transport and the like — you need a permit from the prefectural governor under Article 14, paragraph 1 of the Waste Management Act (Act on Waste Management and Public Cleansing). To obtain it, the facilities such as vehicles and containers and the applicant's ability must meet the standards set by Ministry of the Environment ordinance (Article 14, paragraph 5, item 1), the applicant must not fall under the disqualifications (item 2 of the same paragraph, which applies Article 7, paragraph 5, item 4), and the operator or officers must have completed the course run by the Japan Waste Management Association (JW Center). What kind of business needs an industrial waste collection and transport permit?
Industrial waste means waste arising from business activity that falls within categories set by law, such as cinders, sludge, waste oil, waste plastics and rubble. When you collect and transport such waste on entrustment from another party, as a business (for consideration, repeatedly and continuously), this permit is required.
The dividing line is "whose waste you transport."

What exactly are the "disqualifications" that block a permit?
A disqualification is a ground that, if any one of them applies, prevents you from obtaining the permit. For industrial waste collection and transport, Article 14, paragraph 5, item 2 applies Article 7, paragraph 5, item 4, mainly setting out the following.

The 2022 revision of the Penal Code unified imprisonment with and without labour into "imprisonment (kokin-kei)," and the provision is worded as imprisonment or a heavier penalty. Disqualifications extend not only to the applicant but also to a company's officers and certain employees. If a disqualification arises after the permit is granted, the permit is revoked, and there is a duty to notify when one arises. If you have a past criminal record, it is important to check early whether a disqualification applies.
When and who should complete the course?
The application requires a completion certificate for the course run by the Japan Waste Management Association (JW Center). You must complete it before applying.

The validity of the certificate and the treatment of the renewal course differ by municipality's examination standards, so check the latest guidance of the prefecture to which you apply.
How do the site requirements change if you carry out transfer and storage?
Collection and transport is divided into "without transfer-storage" and "with transfer-storage."
- Without transfer-storage: waste is transported straight from the discharge site to the disposal or recycling facility without being unloaded on the way. Many new permits start from this category.
- With transfer-storage: waste is reloaded onto another vehicle or stored temporarily on the way. In this case, the storage site must meet standards such as enclosures and signboards, sorting by type, storage upper limits (quantity), and prevention of scattering, leakage and odour, and the examination is stricter.

A depot (parking) for the transport vehicles must, separately from the transfer-storage site, be able to show title to use (ownership or a lease) in writing. Arranging and leasing the depot land or the land used for transfer-storage is the role of a licensed real estate broker. In which prefecture do you obtain the permit, and when is renewal due?
Article 14, paragraph 1 provides that, where you conduct only transport as a business, the permitting authority is the prefectural governor with jurisdiction over the "area where the industrial waste is loaded and unloaded." That is, for collection and transport without transfer-storage, a permit is required in the prefectures of both the loading place and the unloading place, and no permit is required in a prefecture through which you merely pass. There are also areas where a city designated by cabinet order issues its own permits.
The validity period is every five years (Article 14, paragraph 2); because it lapses with the passage of the period, you complete the renewal course before the deadline and then apply for renewal. If you are certified as meeting the standards of the system for certifying superior industrial waste disposal operators, the validity period becomes seven years.

Q. Do I need a permit even to transport my own company's waste with my own truck?
A. Transporting industrial waste arising from your own business to a disposal site yourself ("in-house transport") in principle does not require a collection and transport permit. However, you must observe the statutory transport standards, such as preventing scattering and leakage in transit. If you transport another party's (another company's) industrial waste on entrustment, a permit is required as a business activity.
Q. Can I transport anywhere in Japan if I have a permit?
A. No. For collection and transport without transfer-storage, a permit is required in each prefecture with jurisdiction over the area where the industrial waste is loaded and unloaded. Permits are required in both the prefecture where you load and the prefecture where you unload, and no permit is required in a prefecture through which you merely pass.
