Opening a shop or office in a container or trailer house — what to check when choosing the property and land

A container or trailer house is not a building if it can be moved at any time and freely, but once it is fixed to the land and used continuously it becomes a building under the Building Standards Act, triggering a building confirmation and use-district limits. That dividing line is the starting point for choosing the property and land. Final legality lies with a specified administrative agency and an architect, business permits with an administrative scrivener, and the tax category with a tax accountant and the municipality.
In short: A container or trailer house is not a building if it can be moved at any time and freely, but once it is fixed to the land and used continuously it becomes a building under the Building Standards Act, triggering a building confirmation and use-district limits. That dividing line is the starting point for choosing the property and land. The final legality judgment lies with a specified administrative agency and an architect, business permits with an administrative scrivener, and the tax category with a tax accountant and the municipality.
This article is for business owners who want to start a shop, office or unstaffed retail stand at low cost, and for landowners thinking of placing a container or trailer house on idle land; it organises the "can you place it / can you build it" assessment from the Building Standards Act, the City Planning Act and the Local Tax Act, together with national technical guidance. What we handle is the survey of the land and property, the assessment of the siting, and the brokerage of the sale or lease. Whether it is a building, whether it conforms to the use district, and whether it amounts to an existing-nonconforming or illegal building are judged finally by an architect and a specified administrative agency (building official); permits and notifications for restaurants, retail and the like are handled by an administrative scrivener; whether the fixed-asset tax is a vehicle tax or a building tax is judged finally by a tax accountant and the municipal property-tax section; and registration of a fixture that becomes affixed to the land and requires registration is handled by a judicial scrivener. These are independent entities from Yotsuba Real Estate Co., Ltd. (四葉不動産株式会社), engaged separately for each service under a separation-of-engagement arrangement. For the whole picture of change of use and confirmation, see changing a property with no completion inspection certificate to welfare use; for reading commercial property against the use district, see care-business premises and the use district.
Do a container or trailer house become a "building," and in what case do they not?
The dividing line is "is it fixed to the land" and "can it be moved at any time and freely." If it is a building, the whole set of controls — building confirmation, use district, structure — applies; if not, they in principle do not. This is the first decision point in choosing the property and land.
The Building Standards Act defines a building as, among others, "a structure fixed to the land, having a roof and either columns or walls" (Building Standards Act Art. 2(i)). For trailer houses, those that can be moved at any time and freely judging from scale, form and installation are held not to be buildings, while those with stairs, porches, verandas or fences that obstruct movement, or with water, electricity or gas piping/wiring that is not an easily detachable connection, are treated as buildings (former Ministry of Construction Jūshihatsu No. 170, 31 March 1997, "On the treatment of trailer houses under the Building Standards Act"). For containers too, one that is fixed to the land in a state where it cannot be moved at any time and freely and is used continuously as a warehouse, shop, etc. is treated as a building under Building Standards Act Art. 2(i), and the state has called for thorough corrective guidance against illegal buildings (Kokujūan No. 5, 26 December 2014; note also the risk of toppling in an earthquake when several are stacked).
| State | Building? | Example controls |
|---|---|---|
| A vehicle movable at any time and freely (a trailer house meeting the standards) | In principle not | Building confirmation and use district in principle do not apply (managed on the Road Transport Vehicle Act / Vehicle Restriction Order side) |
| Fixed to the land, used continuously (a container shop, a trailer house with fixed utilities) | Yes | Building confirmation, use district, structure/fire, road-access apply |
Whether it is in fact a building is judged case by case by the specified administrative agency from scale and installation. Even if it is a vehicle at installation, if stairs or piping are later fixed and affixation is recognised, it is appropriately treated as a building from that point. Please confirm the final judgment with an architect or a specified administrative agency.
Where can you place a trailer house — which use districts — and what happens in an urbanisation-control area?
In a vehicle state that is not a building, the building controls of the use district and the urbanisation-control area in principle do not apply. Once it is a building, the use restriction of the use district (such as the size cap on shops) and the building permit in an urbanisation-control area come to the fore.
An urbanisation-control area is an area where urbanisation should be restrained (City Planning Act). To build or rebuild a building in the area, a development permit (Art. 29) is in principle required for development activity, and a building permit (Art. 43) for building without development; unless permitted, a building cannot be built. So with the same container, if it is a vehicle (not a building) a building permit is in principle unnecessary, but the moment it becomes affixed and turns into a building, a reversal occurs: in a control area it in principle cannot be built. Within an urbanisation-promotion area, it is subject to the use restriction of the use district, so check whether the district allows use as a shop or office and whether it is within the size cap.
| Area / district | Vehicle (not a building) | Building |
|---|---|---|
| Urbanisation-promotion area (with use districts) | Use-district building controls in principle do not apply | Must conform to the use/size restriction of the use district |
| Urbanisation-control area | Building permit in principle unnecessary (other laws and municipal guidance are separate) | Development permit (Art. 29) / building permit (Art. 43) in principle required |
Even as a vehicle, a municipal guidance guideline or ordinance may reach long-term placement or business use. Confirm the use-district possibility and the need for a control-area permit at the city-planning / building-guidance window of the specified administrative agency or municipality.
At what point is a building confirmation required, and how do illegal and existing-nonconforming buildings differ?
If it is a building, certain building acts such as new construction or extension require a building confirmation before work starts (Building Standards Act Art. 6), and changing the building's use is also subject by analogy to a confirmation application depending on scale and use (Art. 87). Building without a confirmation is an illegal building; an existing-nonconforming building is a different thing.
An illegal building is one that does not conform to the law at the time of building or use, subject to corrective guidance and orders. An existing-nonconforming building was lawful when built but, through later amendment or a city-planning change, no longer meets current standards; it is not immediately illegal, but conformity to current standards may be required on extension or renovation. A common accident sequence is to install a container shop without a confirmation and then, at the business-permit stage, have its building status come to light and corrections demanded. Whether a confirmation application is needed and whether it is existing-nonconforming or illegal are the area of an architect and the specified administrative agency; we only point out, at the property-survey stage, the need for these confirmations.
| Category | Content | Who is involved |
|---|---|---|
| Building confirmation (Art. 6) | Received before work on new construction, extension, etc. | Architect / specified administrative agency (building official) |
| Confirmation for change of use (Art. 87) | Applied by analogy for a change of use of certain scale/use | Architect / specified administrative agency |
| Illegal building | A non-conforming state; subject to corrective guidance and orders | Specified administrative agency |
| Existing-nonconforming | Lawful when built, non-conforming after amendment; conformity may be required on extension/renovation | Architect / specified administrative agency |
How do the fixed-asset tax and the city-planning tax change between vehicle treatment and building treatment?
The character of the tax changes. If treated as a building (house) affixed to the land, it can be subject to the fixed-asset tax (on houses) and, within an urbanisation-promotion area, the city-planning tax. A trailer house registered as a vehicle movable at any time is generally handled on the vehicle-tax side (the automobile tax / light-vehicle tax system) rather than as a house for fixed-asset-tax purposes.
The fixed-asset tax is imposed on the owner of the fixed asset, and for a house on the person registered or recorded as owner in the registry or the supplementary house tax ledger (Local Tax Act Art. 343). The levy date is 1 January of the year in which the first day of the fiscal year falls, and taxation is fixed by the state of affairs as of 1 January (Art. 359). Structures and equipment used in business can be subject to the fixed-asset tax as depreciable assets. Which tax category it actually falls into (house, vehicle or depreciable asset) is judged finally by the municipal property-tax section and a tax accountant, because it varies with the property's affixation and registration status. We do not assert the tax amount or whether tax can be saved.

| Treatment | Main tax | Judge / confirm with |
|---|---|---|
| A house affixed to the land | Fixed-asset tax (house) + city-planning tax in an urbanisation-promotion area | Municipal property-tax section / tax accountant |
| A trailer house registered as a vehicle | Vehicle-side tax (automobile tax / light-vehicle tax system) | Municipality / transport branch office / tax accountant |
| Business structures / equipment | Can be subject to the fixed-asset tax as depreciable assets | Municipal property-tax section / tax accountant |
Fixing the tax category belongs to an unverified individual judgment and is not asserted here.
Before choosing the property and land, how should you divide the consultation among the real estate company, the architect and the administrative scrivener?
Thinking in order avoids confusion. First we handle the survey of the land and property, the assessment of the siting, and the brokerage of the sale or lease. Whether it is a building, conforms to the use district, and the handling of the confirmation application and existing-nonconforming status go to an architect and the specified administrative agency; the business permit to an administrative scrivener; the tax category to a tax accountant and the municipality; and a fixture requiring registration to a judicial scrivener.
For consultations with us on inherited property or using idle land, see inherited-property consultations; for commercial property and investment, see investment and commercial-property consultations; for building a base at opening, see office and shop-premises consultations. Each specialist — Yotsuba Real Estate Co., Ltd. (四葉不動産株式会社), 四葉行政書士事務所, 四葉社会保険労務士事務所, and other specialists (architect, judicial scrivener, tax accountant) — is an independent entity, engaged separately for each service. We proceed by direct contract, direct invoice and direct payment; no referral or lead-transfer fees are exchanged. What we handle extends only to the assessment and brokerage of the property; the final judgments on legality, tax and permits are made by each qualified professional.
| Where to consult | What they handle |
|---|---|
| Real estate company (us) | Land/property survey, siting assessment, sale/lease brokerage |
| Architect / specified administrative agency | Building status, use-district conformity, building confirmation / change of use, existing-nonconforming / illegal judgment |
| Administrative scrivener | Business permits and notifications for restaurants, retail, etc.; drafting of development-permit and other applications |
| Tax accountant / municipality | Judgment of the fixed-asset-tax category (house, vehicle, depreciable asset) |
| Judicial scrivener | Registration of a fixture that becomes affixed to the land and requires registration |
Frequently asked questions
Q. If I just place a container on idle land as an unstaffed retail stand, do I not need a building confirmation?
A. A container fixed to the land and used continuously is treated as a building under Building Standards Act Art. 2(i), and in principle a building confirmation (Art. 6) and use-district / structure controls apply (Kokujūan No. 5, 26 December 2014). Because the treatment changes with whether it is in a state movable at any time and freely — without fixed foundations or piping — confirm with the specified administrative agency before installation.
Q. Can a trailer house be placed in an urbanisation-control area without a building confirmation?
A. A trailer house recognised, from scale, form and installation, as movable at any time and freely is not a building, and in that case a building permit is in principle unnecessary (former Ministry of Construction Jūshihatsu No. 170, 31 March 1997). But if stairs or piping are fixed and affixation is recognised, it becomes a building and in principle can no longer be built in a control area (City Planning Act Art. 43). The final judgment is made by the specified administrative agency.
Q. Is the fixed-asset tax on a container shop the same as a car's annual inspection cost?
A. No. If treated as a house affixed to the land, it can be subject to the fixed-asset tax (house) and, in an urbanisation-promotion area, the city-planning tax (Local Tax Act Arts. 343, 359). A trailer house registered as a vehicle is generally handled on the vehicle-tax system. Which category it falls into is confirmed by the municipal property-tax section and a tax accountant.
Q. After installing, I was told at the business-permit stage that it is a "building." What should I have checked first?
A. At the stage of choosing the property and land, the order is to confirm with an architect / specified administrative agency whether it is a building (affixation, movability), whether it can be placed in the use district / control area, and whether a confirmation application is needed. Because the business permit (administrative scrivener) presupposes conformity with the Building Standards Act, settling building legality first avoids having to redo corrections.

The content of former Ministry of Construction Jūshihatsu No. 170 (31 March 1997, "On the treatment of trailer houses under the Building Standards Act") is based on the notice of MLIT (the former Ministry of Construction), but whether a particular property is in a state "movable at any time and freely," the size cap on shops in a use district and the need for a change-of-use confirmation, and whether the fixed-asset tax falls into the house, vehicle or depreciable-asset category vary by case and so are not asserted here but left as unverified; legality is confirmed by an architect and the specified administrative agency, and tax by a tax accountant and the municipal property-tax section, against original materials.
