When Technical Intern Training shifts to Employment for Skill Development, what happens to a supervising organisation's permission?

With the shift from Technical Intern Training to Employment for Skill Development, an existing supervising organisation does not automatically become a supervising-and-support organisation; it must newly obtain permission. This article organises, from an administrative scrivener's practice, the enforcement date, the pre-enforcement applications, the plan certification, and how the immigration-permit and labour/social-insurance roles divide — limited to what has been verified.
In short: with the shift from Technical Intern Training to Employment for Skill Development, an existing "supervising organisation" does not automatically slide over into a "supervising-and-support organisation"; it must newly obtain permission as a supervising-and-support organisation (Immigration Services Agency, "Employment for Skill Development Q&A," Q33). The system's enforcement date is 1 April 2027 (Reiwa 9), based on the amending Act relating to Employment for Skill Development (Act No. 60 of 2024). So that procedures can proceed without waiting for enforcement, pre-enforcement applications for supervising-and-support organisation permission have been accepted from 15 April 2026 (Reiwa 8), and pre-enforcement applications for certification of the (supervision-type) Employment for Skill Development plan from 1 September 2026 (the application point being the Head Office Examination Division annex of the Organization for Technical Intern Training). A holder of supervising-and-support organisation permission is stated to be deemed to hold general supervising business permission under the Technical Intern Training system (same Q&A, Q39). Supporting the drafting of the permission application and the plan certification is within the scope of an immigration-filing-agent administrative scrivener; the design of working conditions, work rules, social insurance and wages is for a labour and social security attorney; and labour disputes are for a lawyer — each on the premise that you contract separately as an independent business. Yotsuba Labor and Social Security Attorney Office is a separate business from our office. Because enforcement dates and transitional measures may be changed or supplemented with further operational information, this article is limited to what could be verified and shows where to confirm the latest. This article is general information and does not determine or guarantee whether an individual permission will be granted. Our office receives no referral fee.
When shifting to Employment for Skill Development, how does a Technical Intern Training supervising organisation's position change?
Employment for Skill Development is an acceptance framework newly created in place of Technical Intern Training, with the aims of securing and developing human resources. Its basis is the amending Act relating to Employment for Skill Development (Act No. 60 of 2024, promulgated 21 June 2024), which amends the Act on Proper Technical Intern Training and Protection of Technical Intern Trainees and others. The residence status for acceptance is placed within Appended Table I of the Immigration Control and Refugee Recognition Act.
The role corresponding to the "supervising organisation" that supervised accepting bodies under Technical Intern Training is, under Employment for Skill Development, carried by the "supervising-and-support organisation." It is not merely a change of name; the permission framework itself switches to that of the new system. The Immigration Services Agency's guidance gives the start of the system's operation (enforcement date) as 1 April 2027 (Reiwa 9). The starting point, therefore, is that a Technical Intern Training supervising organisation cannot simply continue to operate as a supervising-and-support organisation after the enforcement date. For how this differs from a registered support organisation (the outsourced-support body under Specified Skilled Worker), see Registration of a registered support organisation and the support plan.
Must you newly obtain supervising-and-support organisation permission, and are there transitional measures?
Yes, you must newly obtain permission. The Immigration Services Agency's "Employment for Skill Development Q&A," Q33, states that, to perform work relating to Employment for Skill Development, a supervising organisation must newly obtain supervising-and-support organisation permission. The qualification is not carried over automatically.
At the same time, a treatment to avoid a gap across enforcement is shown. Q39 of the same Q&A states that a person who has obtained supervising-and-support organisation permission is deemed to hold general supervising business permission under the Technical Intern Training system, so no separate renewal is required for the supervising organisation's permission period.
| Item | Content (Immigration Services Agency guidance) |
|---|---|
| Enforcement date | 1 April 2027 (Reiwa 9) |
| Pre-enforcement application for supervising-and-support organisation permission | Accepted from 15 April 2026 (application point: Head Office Examination Division annex, Organization for Technical Intern Training) |
| Pre-enforcement application for certification of the (supervision-type) plan | Accepted from 1 September 2026 |
| Treatment of an existing supervising organisation | No automatic shift; new supervising-and-support organisation permission required (Q33) |
| If permission is obtained | Deemed to hold general supervising business permission under Technical Intern Training (Q39) |
The acceptance period for pre-enforcement applications, and the rough time needed from application to the start of operations, may change with operational updates. When considering an application, be sure to confirm the latest acceptance status on the official pages noted below.
What does certification of the Employment for Skill Development (acceptance) plan examine?
Under Employment for Skill Development, a mechanism is set up whereby the Employment for Skill Development plan prepared by the accepting body (such as a company) is certified. This corresponds to the certification of the technical intern training plan under Technical Intern Training. Certification of the plan is expected to examine the premises for proper acceptance — such as the field and work covered by the development, the development period and goals, the acceptance structure, and remuneration. It is also stated that obtaining certification of a supervision-type plan presupposes supervising-and-support organisation permission (including a pre-enforcement application).
That said, the detailed examination items, criteria and forms are in part to be made concrete in the operational guidelines towards enforcement, and must be confirmed within the range that has been settled and published. This article shows, as what could be confirmed from primary information, the broad outline of the examination (that a plan-certification system is established and is linked with supervising-and-support organisation permission), and leaves the individual criteria values and the details of forms to the latest published materials. On the angle of building a company's structure to employ foreign nationals, The Business Manager residence status and company formation is also a useful reference.
How do the immigration-permit (administrative scrivener) and labour/social-insurance (labour and social security attorney) roles divide?
Preparing to accept workers under Employment for Skill Development overlaps procedures of different natures: permits and licences (immigration-related) and labour (labour and social-insurance related). At Yotsuba, we divide and refer these on the premise that you contract with each as an independent business, as follows.
| Field | Who handles it (each as an independent business under a separate contract) |
|---|---|
| Supporting the drafting of the supervising-and-support organisation permission application and the Employment for Skill Development plan certification, and immigration filing-agency for residence status | Immigration-filing-agent administrative scrivener |
| Preparing notice of working conditions, work rules, wage rules, Article 36 agreements, etc. | Labour and social security attorney (Yotsuba Labor and Social Security Attorney Office is a separate business) |
| Application and procedures for social insurance and labour insurance | Labour and social security attorney |
| Negotiation and litigation in labour disputes and individual labour-relations disputes | Lawyer |

What the administrative scrivener handles is immigration-related filing agency and support for drafting the permission/certification application documents. Filing agency under immigration law is within the range an administrative scrivener who has filed the filing-agent notification can perform. By contrast, the design and procedures for working conditions and social insurance are the work of a labour and social security attorney, and representation in a labour dispute is the work of a lawyer; an administrative scrivener does not do these. For parts where the enforcement timing is not yet settled, when and with what information should you confirm?
Employment for Skill Development is being made concrete — operational guidelines, forms and the details of transitional measures — in stages towards enforcement on 1 April 2027 (Reiwa 9). Therefore the application acceptance period, examination criteria, required documents and the content of transitional measures are best confirmed directly in the official materials at the point of writing and of applying.
| What to confirm | Where to confirm the primary information |
|---|---|
| System outline, enforcement date, pre-enforcement applications | Immigration Services Agency, "Employment for Skill Development Q&A" |
| Procedures for the permission application and plan certification | Organization for Technical Intern Training (guidance on pre-enforcement applications) |
| Treatment of labour and social insurance | Ministry of Health, Labour and Welfare, "On the Employment for Skill Development system for foreign nationals" |

As a transitional measure on the Technical Intern Training side, the Immigration Services Agency and the Organization for Technical Intern Training have published that, with the enforcement of Employment for Skill Development, there may be cases from April 2027 (Reiwa 9) where a move to Technical Intern Training (No. 3) is not possible (accessed 2026-10-14). Because such transitional measures differ in treatment by individual, applying them to an individual acceptance plan should be premised on the official materials and confirmation by a qualified professional. This article organises information limited to what has been settled and published.
FAQ
Q. Can the current supervising organisation become a supervising-and-support organisation as it is?
A. It cannot shift as it is. The Immigration Services Agency's "Employment for Skill Development Q&A," Q33, states that performing work relating to Employment for Skill Development requires newly obtaining supervising-and-support organisation permission. However, once permission is obtained, the holder is deemed to hold general supervising business permission under Technical Intern Training, and no separate renewal is required for the supervising organisation's permission (Q39).
Q. When is the enforcement date, and can you apply before enforcement?
A. The system's enforcement date is 1 April 2027 (Reiwa 9). So that things can proceed without waiting for enforcement, pre-enforcement applications for supervising-and-support organisation permission have been accepted from 15 April 2026 (Reiwa 8), and pre-enforcement applications for certification of the (supervision-type) Employment for Skill Development plan from 1 September 2026 (the application point being the Head Office Examination Division annex of the Organization for Technical Intern Training). Because the acceptance period may change, confirm the latest status in the Organization's guidance before applying.
Q. Can an administrative scrivener handle the permission application or plan certification?
A. Supporting the drafting of application documents and immigration filing-agency for residence status are within the scope of an administrative scrivener who has filed the filing-agent notification. On the other hand, labour design such as work rules, wages and social insurance is the work of a labour and social security attorney, and representation in a labour dispute is the work of a lawyer. You contract with each as an independent business separately.
Q. Can you judge whether permission or certification will be granted for an individual acceptance?
A. This article is general information and does not determine or guarantee whether an individual permission or certification will be granted. Examination criteria and forms are in part to be made concrete in the operational guidelines; please base your judgment on the latest settled and published materials and, where needed, on confirmation by a qualified professional.
