Premises standards for residential (short-stay) postpartum care under the Maternal and Child Health Act (母子保健法)

The March 2026 national guideline for short-stay postpartum care under the Maternal and Child Health Act (母子保健法) specifies at least one nursing professional on duty around the clock. This guide separates the treatment of the specified facilities under hotel and building law from premises and municipal checks before contracting. Bedroom area, fire classification and consolidated statutes and amendment histories remain pending qualified review.
Key points: For short-stay postpartum care under the Maternal and Child Health Act (母子保健法), the March 2026 national guideline specifies at least one nursing professional on duty around the clock. Check rooms, counselling and infant-care facilities, and municipal additional conditions before contracting for a property.
This article is for people who want to open residential postpartum care in a former clinic, old inn or detached house, written from a viewing perspective. It does not repeat clinic premises or authorised nursery premises; here we address the conditions that arise because mothers and infants stay overnight.
We handle property selection, preliminary checks on zoning and fire safety, and brokerage of viewings. The commissioning contract and final confirmation of the implementation standards lie with the municipality, staffing of midwives and nurses and wage and social-insurance design with a social insurance and labour consultant, medical judgments about the infant's health with a doctor or midwife, and the change-of-use confirmation application, where required, with an architect. These are independent entities from 四葉不動産株式会社, engaged separately for each service.
What premises standards does residential postpartum care require?
Article 17-2 of the Maternal and Child Health Act provides that municipalities shall endeavour to offer postpartum-care services to "women who have not passed one year since childbirth, and infants" who need them; it took effect on 1 April 2021 (amendment by Act No. 69 of 2019; the latest amendment number is unverified). The service has three types — short-stay, day-use and home-visit — and the residential form is the short-stay type.
The standards are set by municipalities in their implementation rules, informed by ministerial ordinance and the Children and Families Agency's "Prenatal/Postnatal Support Service and Postpartum Care Service Guideline" (March 2026 edition; reviewed 11 October 2026). The points relevant to the property are these.
| What to check on a viewing | Perspective |
|---|---|
| Room where mother and infant stay | Space and privacy for one mother-and-infant pair to rest; confirm minimum-area and municipal requirements with the authority |
| Bathing and nursing area | Hot water and drainage for bathing guidance, and a hygienic zone |
| Cooking and serving | Facilities matching how meals are provided (in-house cooking or external delivery) |
| Consultation / care room | A place where a midwife can give individual consultation and health guidance |
| Staff flow | Work and rest space supporting at least one nursing professional on duty around the clock |
Distinguish staffing from floor area. The March 2026 guideline specifies at least one nursing professional, such as a midwife, public-health nurse or nurse, at all times; for short stays, at least one must be on duty around the clock regardless of the setting (printed pages 11–12; accessed 12 October 2026). A nationwide minimum bedroom area and each municipality’s additional requirements have not been fully verified here. Confirm capacity, plans and staffing with the local authority.
How should zoning and building use be confirmed?
First confirm the building's registered use (residence, inn, clinic, etc.) and the zoning of the location. Even in a residential zone, which building uses are allowed is governed by the restrictions in Appended Table 2 of the Building Standards Act (建築基準法). When converting a former clinic or old inn to residential postpartum care, the use of the building may change, so check early whether a change-of-use confirmation application is required.
Article 87 of the Building Standards Act provides that, when converting use to a special building listed in column (i) of Appended Table 1 (excluding conversions between similar uses), a confirmation application is required if the combined floor area of that part exceeds 200 m². A 2019 amendment effective 25 June 2019 raised the threshold from over 100 m² to over 200 m². Even where a confirmation application is unnecessary at 200 m² or less, compliance with the Building Standards Act provisions is still required. Which use category applies and whether a confirmation application is needed should be confirmed with an architect and the competent building official.
Which fire-service category applies and what is required?
Premises involving overnight stays carry heavier fire-safety equipment on the assumption that people sleep there. Automatic fire alarms, guide lights, extinguishers and escape routes vary with the building's scale, number of storeys and number of people sleeping.
Which item of Appended Table 1 of the Fire Service Act Enforcement Order the residential postpartum-care form falls under (medical/welfare type or lodging type) depends on the facility's actual nature, and the fire station with jurisdiction makes the final classification. This article does not assert a category (unverified). Before committing to a property, consult the jurisdictional fire station in advance with a floor plan and the service format, and confirm the required equipment and scope of works. Design and installation of fire equipment are handled by qualified specialists.
How do the procedures differ from a midwifery centre or lodging business?
Residential postpartum care is a different regime from a midwifery centre or a lodging business.
| Regime | Basis | Nature |
|---|---|---|
| Residential postpartum care | Maternal and Child Health Act Art. 17-2 | Municipal service (provided under commission) |
| Midwifery centre | Medical Care Act Art. 2 | Place where a midwife works; may not have facilities to admit 10 or more pregnant/parturient/postpartum women (i.e. 9 or fewer) |
| Lodging business | Hotel Business Act (旅館業法) | Business of lodging people for a fee |

The Ministry of Land, Infrastructure, Transport and Tourism notice of 5 August 2020 states that short-stay facilities under Article 17-2 of the Maternal and Child Health Act, excluding hospitals, clinics and midwifery centres, are outside the Hotel Business Act and are not “hotels or inns” under the Building Standards Act (accessed 12 October 2026). Do not extend this treatment to services outside the municipal programme or Medical Care Act facilities. Confirm the programme scope and actual facility with the authorities; individual building, fire and medical-law compliance is for the relevant authorities and professionals.
What should be confirmed with the municipality before securing a property?
Before rushing a contract, confirm the following with the municipal maternal-and-child-health window: whether there is a commission and the timing of any open call, the room area and equipment required by the implementation rules, the minimum staffing, and the fire and building conditions to be met. Contracting a property first and then finding it falls short of the standards leads to renovation costs or cancellation burdens.
We handle preliminary checks on zoning and fire safety, accompanying viewings and brokerage. The commissioning contract and final confirmation of standards lie with the municipal window, labour design with a social insurance and labour consultant, medical judgment with a doctor/midwife, and change-of-use confirmation with an architect — each as an independent entity, engaged separately. We proceed by direct contract, direct invoice and direct payment; no referral or lead-transfer fees are exchanged. See also investment and commercial property and commercial premises enquiries.
Frequently asked questions
Q. Can residential postpartum care be run in a detached house?
A. Not universally impossible. Confirm with the municipal window, an architect and the fire station whether you can provide the room, bathing, cooking and consultation spaces and staffing, and clear the change-of-use and fire conditions, before deciding.
Q. Is converting a former inn easy because it already has lodging facilities?
A. Even with lodging facilities, a change of building use may require a change-of-use confirmation application, and the fire classification is reviewed on the actual nature. Confirm the registered use and zoning first.
Q. Is there a nationwide figure for the facility's floor area?
A. A nationwide minimum bedroom area has not been verified here. This is separate from staffing: the March 2026 national guideline specifies at least one nursing professional on duty around the clock for short stays. Confirm individual area requirements and additional staffing conditions with the local authority.
Q. Will the real estate company judge compliance with the implementation standards?
A. No. We go as far as preliminary checks and brokerage. Compliance and the final commissioning judgment lie with the municipality, medical judgment with a doctor/midwife and labour matters with a social insurance and labour consultant, each engaged separately.
