A mortgage covered by group credit life insurance is often repaid in full by the insurance when the borrower dies, and the mortgage can then be discharged and the home sold. Where there is no such insurance or debt remains, discuss repayment and a negotiated sale with the lender, and if renunciation of inheritance is possible, consult a lawyer before selling.

Key points: A mortgage covered by group credit life insurance is often repaid in full by the insurance on the borrower's death, in which case the mortgage can be discharged and the home sold. Where there is no such insurance or debt remains, discuss repayment and a negotiated sale with the lender; if renunciation of inheritance is a possibility, confirm with a lawyer before selling.

This article is for heirs who have inherited a family home with a mortgage (security interest) still outstanding. It does not repeat selling an inherited pre-1981 earthquake-standard condominium or the flow of a sale by conversion-and-division; here we focus on the loan and the mortgage.

We handle valuation, matching the remaining debt against the price, and brokerage of the sale. Inheritance registration and discharge of the mortgage lie with a judicial scrivener, repayment terms and any negotiated-sale discussions with the lender, acquisition cost, capital-gains tax and the vacant-house special exemption with a tax accountant, and the judgment on renouncing inheritance in an insolvency and disputes among co-heirs with a lawyer. These are independent entities from 四葉不動産株式会社, engaged separately for each service.

If group credit life insurance is attached, does the loan disappear?

Many home loans carry group credit life insurance (dan-shin), under which, when the borrower dies, the insurance repays the loan in full — the common mechanism. In that case the heir does not bear the remaining debt and can discharge the mortgage after repayment. However, such insurance is not necessarily attached to every loan: with products like Flat 35 enrolment is optional, and there are cases of non-enrolment or non-payment due to disclosure issues.

First confirm with the lender whether the insurance exists, whether it will pay, and the amount of remaining debt. In inheritance, the heir succeeds to all rights and obligations belonging to the decedent's property (Civil Code (民法) Article 896). The loan debt is within this succession, and whether it is repaid by the insurance is the fork in the road for whether the heir bears the debt. Because the insurance terms and the handling of debt certificates differ by product, confirm them in the policy terms and the lender's reply (the individual policy content here is a general practice summary).

Why can't the home be sold while the mortgage remains? (the order of discharge)

A mortgage is the right the lender set over the home to secure the loan. Legally the home can be sold with the mortgage still attached, but because buyers avoid a property that "goes to auction if repayment lapses," in practice the mortgage is discharged first (or repaid in full from the sale proceeds at the same time) before handover.

The order of discharge is as follows.

StepProcedureWho
1Confirm the balance, insurance and repayment methodHeir / lender
2Confirm inheritance and sale-related registrations; distinguish the sale contract from registration and settlementJudicial scrivener
3Repayment at settlement or the agreed stage, and cancellation of the mortgage registrationJudicial scrivener
4Transfer of ownership to the buyerJudicial scrivener

Inheritance registration became mandatory on 1 April 2024, requiring an application within three years of learning of the acquisition (Real Property Registration Act (不動産登記法) Article 76-2; failure without justifiable grounds can incur a civil fine of up to ¥100,000). Even when selling, inheritance registration cannot be avoided. Discharge of the mortgage, as a registration of rights, is in principle applied for jointly by the registration holder and the registration obligor (Article 60). Registration is the judicial scrivener's area.

What if the sale price falls below the remaining debt (negative equity)?

Where the remaining debt exceeds the valuation, this is "negative equity." The sale proceeds alone cannot repay it in full, so the mortgage generally cannot be removed and an ordinary sale becomes difficult. Options include making up the shortfall with your own funds, or proceeding by a "negotiated sale" in which the lender agrees to remove the mortgage.

A negotiated sale presupposes negotiation with the lender, and the repayment terms and whether the mortgage can be removed are the lender's decision. What we can do is match the valuation against the remaining debt early to assess whether it is negative equity, and organise the sale outlook. Negotiation of repayment terms lies with the lender, and the registration that is a precondition lies with the judicial scrivener.

When renunciation of inheritance may be chosen, what should be watched before selling?

Where the debt greatly exceeds the assets and insolvency is suspected, renunciation of inheritance is an option. Renunciation is filed with the family court within three months of learning that inheritance has begun for oneself (Civil Code Article 915). The decision is made within this deliberation period.

While considering renunciation, it is safest not to sell or dispose of the home. Disposing of all or part of the inherited property is deemed simple acceptance (Article 921), which may make renunciation impossible. On renunciation, the heir is deemed never to have been an heir from the outset (Article 939). Whether to renounce or to sell and then settle is a final judgment to confirm with a lawyer in light of the full picture of the debt. We go as far as showing the outlook on the asset side through valuation.

In what order are repayment and costs settled from the sale proceeds?

When the sale closes, the proceeds settle the remaining debt and various costs. The rough order is as follows.

Object of settlementContent
Loan remaining debtRepayment in full to the mortgagee (lender); this discharges the mortgage
Registration costsCosts of inheritance, discharge and transfer registration (judicial scrivener's fee, registration licence tax)
Brokerage feeBrokerage commission to the real estate company
TaxCapital-gains tax on the gain. The acquisition-cost add-on (Special Taxation Measures Act (租税特別措置法) Art. 39) and the vacant-house exemption (up to ¥30 million, or ¥20 million in specified cases) (Art. 35(3)) cannot be used together; which is more favourable is calculated by a tax accountant

The vacant-home deduction is capped at 30 million yen. For transfers on or after 1 January 2024, the cap is 20 million yen where three or more heirs acquired the qualifying house and/or land (National Tax Agency No.3306; accessed 12 October 2026). This count is not automatically the total number of heirs. Ask a tax accountant to assess individual eligibility and the choice against the acquisition-cost addition.

The amount left in hand after settlement varies with the gap between the remaining debt and the price. Tax exemptions have detailed requirements and deadlines, and judging eligibility and relative advantage is the tax accountant's area. See also inherited-property sale consultations. For procedures, engage the lender for debt negotiation, the judicial scrivener for registration and the tax accountant for tax — each as an independent entity, engaged separately. We proceed by direct contract, direct invoice and direct payment; no referral or lead-transfer fees are exchanged.

Frequently asked questions

Q. If group credit life insurance is attached, does the heir not have to pay the loan?
A. Where the insurance repays in full, you do not have to pay. But there are products where enrolment is optional, and cases of non-enrolment or non-payment, so first confirm with the lender whether it exists, whether it will pay, and the remaining amount.

Q. Can the home be sold while the mortgage remains?
A. Legally it can, but because buyers avoid it, in practice the mortgage is discharged and then (or simultaneously with repayment from proceeds) handed over. The discharge registration is handled by a judicial scrivener.

Q. What happens when the remaining debt exceeds the valuation?
A. In negative equity the proceeds alone cannot repay in full and the mortgage often cannot be removed; consider topping up with your own funds or a negotiated sale with the lender's agreement. Repayment terms are decided by the lender.

Q. If I am considering renunciation, may I sell the home?
A. Selling or disposing of it may be deemed simple acceptance and make renunciation impossible (Civil Code Article 921). While renunciation is possible, refrain from selling and confirm with a lawyer before deciding.
