For heirs who have inherited a home with a reverse mortgage (Re-Bars 60) that their parent used, and want to sell it and settle the balance. The principal is repaid in a lump sum when the borrower dies—by the heirs or from the sale of the collateral property. When settling by sale, Yotsuba Real Estate Co., Ltd. organises the appraisal, brokerage, lump-sum repayment at settlement and the mortgage release. Legal evaluation of the balance and whether to disclaim the inheritance go to a lawyer; mortgage release and succession registration to a judicial scrivener—each under separate, independent contracts.

The key point: If you inherit a family home with a reverse mortgage (Re-Bars 60), first contact the financial institution and confirm the principal balance, the repayment deadline and whether it is the non-recourse or recourse type. The principal is repaid in a lump sum when the borrower dies—either by the heirs or from the sale of the collateral property. When settling by sale, we organise the appraisal, brokerage, the lump-sum repayment at settlement and the mortgage release. Legal evaluation of the balance and whether to disclaim the inheritance go to a lawyer; the mortgage release and succession registration to a judicial scrivener.

When you inherit a home where a parent used a reverse mortgage, you worry about the remaining debt, whether you must sell to repay it, and whether to disclaim the inheritance. A reverse mortgage is a housing loan where, during the borrower's life, only interest is paid, and the principal is repaid in a lump sum when the borrower dies. The timing of repayment and the structure of settlement differ from an ordinary housing loan.

The Japan Housing Finance Agency's "Re-Bars 60" (リ・バース60) is a product for people aged 60 and over, offered by private financial institutions with the agency's housing loan insurance attached. The principal is repaid, when the borrower dies, by the heirs in a lump sum or from the sale of the collateral property (the home and land). The starting point is to confirm whether the property you inherited fits this structure.

Yotsuba Real Estate Co., Ltd. (四葉不動産株式会社), based in Bunkyo, Tokyo, provides consultation on property sales and brokerage. We can start by organising the approach and the matters to confirm for a sale that settles the balance.

How is a reverse-mortgage balance treated on inheritance?

Article 896 of the Civil Code provides that an heir succeeds, from the time inheritance commences, to all rights and duties attached to the decedent's property (except those exclusively personal). Accordingly, the reverse-mortgage balance (the duty to repay the loan) is, in principle, succeeded to by the heirs. At the moment of inheritance, you take on the collateral property together with the repayment duty.

Re-Bars 60 is a product in which the principal is repaid in a lump sum at death. Repayment is either a lump-sum repayment by the heirs or repayment from the sale proceeds of the collateral property. Whether to settle by sale or to repay with your own funds and keep the property is for the heirs to choose.

To confirmContent
BalanceThe principal balance and the interest arising until settlement
DeadlineBy when, after death, lump-sum repayment or sale will be required (depends on the institution/contract)
Type of liabilityWhether it is non-recourse or recourse
Joint liabilityWhether a spouse is a co-obligor; the lump-sum repayment time may be when both have died

First contact the handling financial institution and confirm the balance, deadline and contract type in writing. Because the details of repayment and deadlines differ by institution and contract, check with the agreement and a balance certificate. Calculating the balance and determining tax are not our work.

How does the burden on heirs differ between the non-recourse and recourse types?

Re-Bars 60 has two ways of handling a balance that cannot be fully repaid from the sale proceeds of the collateral property. This is where it differs greatly from an ordinary housing loan.

TypeTreatment of a balance not fully repaid from the sale proceeds
Non-recourseThe heirs are not required to repay the remaining debt
RecourseThe heirs bear the duty to repay the remaining debt

With the non-recourse type, after applying the sale proceeds of the collateral property to repayment, any shortfall is not claimed from the heirs. With the recourse type, the heirs must repay any shortfall after sale. Which type your inherited contract is determines whether a burden remains after the sale.

Which type it is was fixed in the contract; heirs cannot re-choose later. Evaluating whether it is non-recourse or recourse, and the legal matters in negotiating with the financial institution, are the lawyer's field. We handle the arrangement of the sale and connect you to a lawyer for the type's legal evaluation and to the financial institution for the balance.

Inheritance centred on an ordinary housing-loan balance and mortgage release is covered in Selling an inherited family home with a remaining housing-loan balance and mortgage (Japanese). This article is limited to the settlement structure specific to a reverse mortgage—lump-sum repayment at death and the non-recourse special clause.

What is the flow and the deadline for selling to settle the balance?

When selling to settle the balance, "lump-sum repayment of the balance" and "release of the mortgage" are added to an ordinary sale. Because the financial institution's mortgage is registered on the collateral property, the basic approach is to repay the balance from the sale price at settlement and release the mortgage at the same time.

StageContent to confirm
Contact/confirmContact the institution and confirm the balance, repayment deadline, type and the mortgage
Appraisal/brokerageAppraisal of the collateral property, brokerage agreement, sales policy
Sale agreementAgreement with the buyer; structuring settlement on the premise of lump-sum repayment
Settlement/releaseRepay the balance in a lump sum from the sale price; register the mortgage release and succession
Settlement of proceedsAny surplus goes to the heirs; with the non-recourse type, a shortfall is not claimed

How much time is allowed after death for lump-sum repayment or sale differs by institution and contract. Confirm with the institution early, including whether there is a grace or deferral period. Registering the mortgage release and the succession is the judicial scrivener's work, and we do not act as agent for registration. Succession registration has been mandatory since 1 April 2024, so the deadline must be checked.

Calculating capital-gains tax (acquisition cost, transfer expenses, applicable special measures) is the tax accountant's field. Whether a gain arises changes with the acquisition cost and the special measures. Confirm the expected tax with a tax accountant.

Disclaiming the inheritance or settling by sale—which to choose, and whom to consult? (Separate mandates)

We often hear, "If there is a balance, should I disclaim the inheritance?" The choice changes depending on whether it is non-recourse or recourse, whether there are other debts, and whether you want to keep the property.

Have a question about your situation?

Tell us about your property search or plans to sell.

Article 915(1) of the Civil Code provides that acceptance or disclaimer of inheritance must be made within three months from when you learn that inheritance has commenced for you (the period may be extended in some cases). If you disclaim, under article 939 you are treated as never having been an heir, and can receive none of the inherited property, including the collateral property.

OptionWhen it tends to fit (general)
Settle by saleNon-recourse type, where you are willing to give up the property; premised on no balance remaining after sale
Repay and keepWhere you can repay in a lump sum with your own funds and wish to keep the home
DisclaimRecourse type with a large balance, or large other debts; but you also lose the other property

With the non-recourse type and no other debts, selling to settle leaves, in principle, no balance, so you may not need to disclaim. With the recourse type or other debts, consider disclaiming too. The deliberation period is a short three months, so early confirmation is needed.

Frequently asked questions

Q. If I inherit a reverse-mortgage balance, must I always pay it myself?
A. Under Civil Code article 896 the repayment duty is, in principle, succeeded to by the heirs. Re-Bars 60 is a product in which the principal is repaid in a lump sum at death, and you may choose a lump-sum repayment by the heirs or repayment from the sale proceeds of the collateral property. With the non-recourse type, a shortfall after applying the sale proceeds is not claimed.

Q. Can I re-choose between non-recourse and recourse after inheriting?
A. No. The type was fixed in the contract. Non-recourse leaves no balance after sale; recourse requires the heirs to repay the shortfall. Confirm with the institution which type your inherited contract is. Legal evaluation of the type is the lawyer's field.

Q. Which is better, disclaiming or selling?
A. With the non-recourse type and no other debts, selling to settle leaves no balance, so you may not need to disclaim. With the recourse type or other debts, consider disclaiming too. Disclaim within the three-month deliberation period; you also lose the other inherited property. Confirm feasibility with a lawyer.

Q. How do settlement and mortgage release proceed on a sale?
A. Because the financial institution's mortgage is registered on the collateral property, the basic approach is to repay the balance in a lump sum from the sale price at settlement and register the mortgage release at the same time. The release and succession registration are handled by a judicial scrivener. We organise the appraisal, brokerage and the settlement structured on the premise of the balance.
