Starting a security-guard company: the certification requirements, disqualifications, and training in full

A security business is started not by a licence but by the certification of the prefectural public safety commission (Security Services Act, Article 4). It requires that none of the disqualifications in Article 3 apply, and that a security-guard instruction and education supervisor can be appointed per office and per business category (Article 22). Guards must receive new-recruit training (in principle 20 hours or more) and in-service training (10 hours or more per year); operating without certification is punishable by a fine of up to 1 million yen (Article 57). A security business is by "certification," not a "licence"—what must you satisfy before starting?
A person who intends to run a security business must receive the certification of the prefectural public safety commission, confirming that none of the items of Article 3 apply (Security Services Act, Article 4). Unlike a restaurant's business licence or an industrial-waste collection licence, the security business uses the word "certification," but it is the same in that you cannot start without it. The application is filed with the prefectural public safety commission having jurisdiction over the location of the principal office (the counter is the competent police station), by submitting an application form and attachments (Article 5).
Security work is divided into four categories in Article 2. Category 1 is facility security guarding against theft and similar incidents at offices, homes, entertainment venues, car parks and amusement parks; category 2 is crowd and traffic-guidance security guarding against injury and similar incidents where people and vehicles crowd; category 3 is transport security guarding against theft of cash, precious metals, works of art and the like in transit; and category 4 is close protection guarding against harm to a person's body in their vicinity (a so-called bodyguard). You state which category of work you will do on the application form and build the training and supervisor structure per category.
The certification is valid for five years from the day of certification. To continue the security business after the term expires, you must receive a renewal, applying at least 30 days before the expiry date. If you carelessly forget to renew and the term lapses, you may fall into operating without certification, so managing the deadline is a practical linchpin.
How far are the disqualifications (bankruptcy, criminal record, organised-crime ties, etc.) checked?
The disqualifications that are the premise of certification are listed in Article 3 of the Security Services Act. Representative ones include: a person who has received a decision to commence bankruptcy proceedings and has not been rehabilitated; a person sentenced to imprisonment or more, or fined for violating the Security Services Act, and for whom five years have not passed since completion of the sentence; a person who has violated the Act or a disposition under it within the last five years; a person likely to commit violent unlawful acts collectively or habitually; an organised-crime member, or a person for whom five years have not passed since ceasing to be one; a person addicted to alcohol, narcotics, cannabis, opium or stimulants; a person unable to properly perform security work due to a mental or physical disorder; and a person under 18.
For a company, if any of its officers falls under the above disqualifications, it cannot be certified either. In other words, when applying as a company, the presence of disqualifications is checked not only for the representative but for all officers such as directors. Whether a disqualification applies is examined through attachments such as a certificate of registered matters, a certificate of no criminal record, a copy of the resident record and a written pledge, together with the public safety commission's investigation.
Which prior conviction or disposition falls under which item, and whether past circumstances amount to a disqualification, is an individual judgement in light of the facts. An administrative scrivener supports preparing and submitting documents on rights, duties and factual certification, but avoids asserting eligibility itself; that rests with the competent police (public safety commission). Evaluation touching on the fate of a criminal case (such as when a conviction lapses) is an attorney's domain.
Who serves as the security-guard instruction and education supervisor, and how is the qualification obtained?
A security business operator must appoint a security-guard instruction and education supervisor for each office and each category of security work handled at that office, from among those holding a supervisor qualification certificate (Security Services Act, Article 22(1)). This supervisor is central to preparing and carrying out the guards' training plan and to instruction and supervision, and their name and address are stated even at the time of the certification application. If there is a reasonable ground to conclude that a supervisor cannot be appointed, the operator cannot be certified in the first place (one of the disqualifications).
The qualification certificate is issued to those who have completed the security-guard instruction and education supervisor course conducted by the prefectural public safety commission, and others. Because the course and certificate are divided by category (1 through 4), an office that does both facility security and traffic guidance needs a supervisor structure holding the certificate for each category. Whether concurrent service is allowed and the details of placement when one office handles several categories are confirmed according to the competent authority's practice.
What are the hours and record obligations for new-recruit and in-service training?
Security operators and guards have a duty to strive to improve their knowledge and ability regarding security work in order to perform it properly, and the operator must provide training to its guards together with necessary instruction and supervision (Security Services Act, Article 21). The training hours are set in Article 38 of the Security Services Act Enforcement Regulations and elsewhere.

When training is given, there is a duty to prepare, keep and retain records such as a training log. Hours and categories can change by amendment—there was also a review in 2024 recently—so confirm with the latest guidance of the competent police or public safety commission before conducting training. If training records are not in order, you may become subject to an on-site inspection or an order.

What happens if you take on security work without certification?
A person who runs a security business without applying for certification, or before receiving the notice regarding certification, is punishable by a fine of up to 1 million yen (Security Services Act, Article 57, item 1). Likewise, a person who continues the security business after the certificate's term expires without applying for renewal, and a person who fails to appoint a security-guard instruction and education supervisor, are subject to a fine of up to 1 million yen (same Article, various items).
If you are fined for violating the Security Services Act, until five years pass from completion of the sentence you fall under a disqualification and cannot apply for certification. Starting without certification means that, for the sake of an immediate order, you may be unable to operate lawfully for the next five years. "Do not start work before receiving the notice of certification" is, in practice, the first fork in the road.
