When converting an office building or vacant shop into a 24-hour unmanned (self-service) fitness gym, what bites is less the use zone than three things: the change-of-use confirmation application, fire safety, and fire/crime prevention during unmanned hours. Building Standards Act (Act No. 201 of 1950) art. 87(1) applies the confirmation rules when a change of use makes the building a special building under art. 6(1)(i) (the part used for that purpose exceeding 200 m²). A fitness gym can fall under Appended Table 1 column (i) item (4) 'sports practice facility', so if the converted part exceeds 200 m² a confirmation application is in principle required (changes between similar uses under Enforcement Order art. 137-18 are excepted). That 200 m² threshold was raised from 100 m² by the 2018 reform, in force 25 June 2019. For fire safety, a gym is generally classed under Fire Service Act Enforcement Order (Cabinet Order No. 37 of 1961) Appended Table 1 item (15) (a workplace not falling under the preceding items) = a non-specified fire-defence target; automatic fire alarms are art. 21, exit/route guide lights art. 26, and the fire-prevention manager Fire Service Act (Act No. 186 of 1948) art. 8 and Order art. 3. We (a real-estate transaction business) handle property introduction and condition-sorting; the change-of-use confirmation is an architect's/designated confirmation body's, fire equipment the fire station's and a fire-equipment officer's, crime-prevention a specialist's—under separate, independent contracts (no referral fees).

The key point: When converting an office building or vacant shop into a 24-hour unmanned (self-service) fitness gym, what bites is less the use zone than three things—the change-of-use confirmation application, fire safety, and fire/crime prevention during unmanned hours. Building Standards Act (Act No. 201 of 1950) art. 87(1) applies the confirmation rules when a building's use is changed into a special building under art. 6(1)(i) (one where the part used for that purpose exceeds 200 m²). A fitness gym can fall under Appended Table 1 column (i) item (4), a "sports practice facility" and thus a special building, so if the converted part exceeds 200 m² a confirmation application is in principle required (changes between similar uses under Building Standards Act Enforcement Order (Cabinet Order No. 338 of 1950) art. 137-18 are excepted). That 200 m² threshold was raised from over 100 m² by the reform in Act No. 67 of 2018, in force 25 June 2019. For fire safety, a fitness gym is generally classed under Fire Service Act Enforcement Order (Cabinet Order No. 37 of 1961) Appended Table 1 item (15) (a workplace not falling under the preceding items) = a non-specified fire-defence target; automatic fire alarms rest on Order art. 21, exit/route guide lights on art. 26, and appointing a fire-prevention manager on Fire Service Act (Act No. 186 of 1948) art. 8 and Order art. 3. In unmanned operation, the capacity calculation (Fire Service Act Enforcement Regulations art. 1-3) and keeping the escape route usable/unlocked in a fire (Fire Service Act art. 8-2-4) are the issues. The change-of-use confirmation and design are an architect's/designated confirmation body's field; fire-equipment need and notification the fire station's and a fire-equipment officer's; late-night unmanned crime-prevention equipment a specialist's. We (a real-estate transaction business) handle the property introduction and condition-sorting, connecting you to each as an independent business contracted with separately (no referral fees are exchanged).

For owners and prospective operators wanting to convert an office building or vacant shop into a 24-hour unmanned self-service gym, this article organises what can be confirmed before deciding on a property, in the order of the Building Standards Act, the Fire Service Act and public materials. This is general information; the final judgment on whether a change of use is required and whether fire equipment is required rests with the specified administrative agency, the competent fire station, and qualified professionals such as architects.

When does a self-service 24-hour gym need a "change-of-use confirmation application"?

Changing how an existing building is used is called a "change of use". Not every change of use needs a confirmation application; the requirement turns on area and use.

Building Standards Act art. 87(1) provides that where a building's use is changed into a special building under art. 6(1)(i) (one where the part used for that purpose exceeds 200 m²), the confirmation rules apply. So a confirmation application is in principle required when "the post-change use is a special building in Appended Table 1 column (i)" and "that part exceeds 200 m²". However, changes between the "similar uses" set out in Building Standards Act Enforcement Order art. 137-18 are exempt from a confirmation application.

This 200 m² threshold was raised from over 100 m² by the reform in Act No. 67 of 2018, in force 25 June 2019. A change of use has a building confirmation but no completion inspection; on finishing the work it is read as a notification to the building official (art. 87(1)). Even at a scale needing no confirmation, the duty to conform to the Building Standards Act itself remains, so whether the evacuation, lighting and fire provisions are met must be checked separately. Whether the use can be changed by interior work alone, and the final judgment on the confirmation requirement and the design, are an architect's and the specified administrative agency's field. Confirmation and use issues when using containers or simple structures are also covered in confirming building certification and use for container/trailer-house shop properties.

How is converting an office or shop into a sports facility treated under the Building Standards Act?

An office is not a special building, but a fitness gym (a sports facility) can fall under Appended Table 1 column (i) item (4), "a bowling alley, ski ground, skating rink, swimming pool or sports practice facility", a special building. Whether it is a "sports practice facility" is judged by the actual use, not the name, so a check with the specified administrative agency and an architect is the premise.

The use-zone restriction must also be checked. Building Standards Act art. 48 and Appended Table 2 set which buildings may be built per use zone, and a sports facility is allowed or not depending on the use zone and scale (it cannot be built in an exclusive industrial zone, for example). The concrete area brackets are set by Appended Table 2 and the Order, so confirm the property's use zone with an architect and the specified administrative agency.

Item to confirmWhat happens office→gymWhere to confirm
Falling under a special buildingA sports facility can fall under Appended Table 1 item (4). Over 200 m² means a change-of-use confirmationArchitect / specified administrative agency
Use-zone restrictionArt. 48 and Appended Table 2 allow or bar it by use zone and scaleArchitect / specified administrative agency
Existing non-conformity / retroactivityThe range of evacuation, fire, etc. provisions required with the change of useArchitect
Presence of a completion certificateWithout one, a change-of-use confirmation is harder to proceedArchitect / specified administrative agency

For a building without a completion certificate, a survey of legal-conformity status may be needed before the change-of-use confirmation. Change-of-use issues for a property without a completion certificate are organised in confirming a change of use to a welfare use for a property without a completion certificate. This article shows only the line of confirmation and leaves the individual conformity judgment to an architect.

In 24-hour unmanned operation, where does the fire service look? Automatic fire alarms, guide lights, escape routes

A fitness gym is generally classed under Fire Service Act Enforcement Order Appended Table 1 item (15) (a workplace not falling under the preceding items), a "non-specified" fire-defence target rather than a specified one. If a sauna (steam bath / hot-air bath) is set up inside the gym, that part can fall under Appended Table 1 item (9)(i), so the classification may change. Classification is judged by the actual use, so a check with the competent fire station is the starting point.

EquipmentSkeleton of the standard for item (15)Basis
Automatic fire alarmItem (15) carries a duty at total floor area of 1,000 m² or more. Under 300 m² in certain cases a small-scale-facility automatic fire alarm may be usableFire Service Act Enforcement Order art. 21
Guide lightsRequired in the basement, windowless storeys and 11th floor and above, etc. Whether a storey is "windowless" is the issueFire Service Act Enforcement Order art. 26
Fire extinguishersInstalled per total floor area and useFire Service Act Enforcement Order art. 10
Installing/notifying fire equipmentOn installation, notify and have the competent fire station inspectFire Service Act art. 17, art. 17-3-3

If a storey counts as "windowless" (one with openings below a level effective for evacuation and firefighting), the need for guide lights and automatic fire alarms can change. Converting a basement former office or a window-poor tenant into a gym makes this windowless-storey judgment drive the cost. The final call on which equipment is needed at what scale is the competent fire station's and a fire-equipment officer's. 24-hour and late-night operation overlaps the fire and noise issues of other sectors such as karaoke, so karaoke-box shop properties and use/fire/noise and internet-café private-room properties, fire and identity checks are also helpful. This article shows only the skeleton of confirmation.

With no staff at night, how do I sort the fire-prevention manager and crime prevention?

Even in unmanned operation, the fire-prevention duty is judged not by whether people are present but by capacity. A non-specified fire-defence target (item (15)) needs a fire-prevention manager appointed and a fire-defence plan drawn up and notified once capacity reaches 50 or more (Fire Service Act art. 8, Fire Service Act Enforcement Order art. 1-2(3), Order art. 3).

Measures for unmanned hoursInform users, remote monitoring/notification, placement of initial fire extinguishers, written into the fire-defence planTokyo Fire Department's guideline for fire safety when parties are absent

Because capacity is calculated by regulation, not by the number of people actually present, even with no permanent staff a property may be calculated at 50 or more by its floor area and need a fire-prevention manager. Operation assuming unmanned hours—how a fire is detected, how evacuation is guided, how the fire service is notified—is helped by the Tokyo Fire Department's guideline for facilities where parties are absent. Late-night unmanned crime-prevention equipment (remote monitoring cameras, entry/exit control, emergency reporting) is a specialist's field, separate from fire. The final call on whether a fire-prevention manager is needed and the content of the fire-defence plan rests with the competent fire station.

Before and after a viewing, what do I confirm with the architect, fire station and crime-prevention firm?

A 24-hour unmanned gym property spans separate professional fields—building (change of use), fire and crime prevention. A real-estate company handles only the property survey and condition-sorting and brokerage; everything else is contracted separately with each professional/firm as an independent business.

These are each independent businesses, contracted with separately. We neither receive nor pay referral or introduction fees. Whether a change of use is required and which fire equipment is required are ultimately judged by the specified administrative agency and the competent fire station, and by an architect and fire-equipment officer. We survey the property's current state (floor area, use zone, presence of a completion certificate, storey and window conditions) and take consultations from arranging who to consult on the building, fire and crime-prevention sides. In your message, write "24-hour unmanned fitness gym" and include the intended floor area, the property's use (originally an office or a shop), the location (municipality), whether it is a conversion of an existing building or a new build, and whether a completion certificate exists (as far as known). Without presuming a change of use is or is not required, we begin with the property survey and arranging which parts to refer to the building, fire and crime-prevention professionals.

Frequently asked questions

Q. To turn an office building into a 24-hour gym, is a change-of-use confirmation application always required?
A. Not always. Building Standards Act art. 87(1) applies the confirmation rules where the post-change use is a special building in Appended Table 1 column (i) and the part used for that purpose exceeds 200 m² in total floor area. A fitness gym can fall under item (4) as a "sports practice facility" and thus a special building, so over 200 m² a confirmation application is in principle required. Changes between similar uses (Enforcement Order art. 137-18) are not required. The actual applicability is judged by the specified administrative agency and an architect.

Q. Even in unmanned operation, must I appoint a fire-prevention manager?
A. Appointing a fire-prevention manager is judged by capacity, not by the number of people present. Item (15), a non-specified fire-defence target, needs appointment and a fire-defence-plan notification at capacity of 50 or more (Fire Service Act art. 8, Order art. 3). Capacity is calculated by the method in Fire Service Act Enforcement Regulations art. 1-3, so even with no permanent staff a property may be calculated at 50 or more by floor area and need an appointment. The final call on need rests with the competent fire station.

Q. Are automatic fire alarms and guide lights mandatory for a 24-hour unmanned gym?
A. In item (15), to which a fitness gym belongs, an automatic fire alarm is a duty at total floor area of 1,000 m² or more (Fire Service Act Enforcement Order art. 21). Guide lights are needed in the basement, windowless storeys and the 11th floor and above, etc. (Order art. 26). For a window-poor tenant or a basement, whether a storey is "windowless" changes the need. Which equipment is needed at what scale is judged by the competent fire station and a fire-equipment officer.

Q. How should I think about fire measures for the hours with no staff at night?
A. The Tokyo Fire Department publishes a fire-safety guideline for facilities where parties are absent, illustrating informing users of unmanned hours, a mechanism to promptly unlock entrances locked by member card in a fire, remote monitoring/notification and placement of initial fire extinguishers, written into the fire-defence plan. Management of facilities needed for evacuation rests on Fire Service Act art. 8-2-4. Confirm the specifics with the competent fire station, and consult a specialist separately on crime-prevention equipment.
