A property for a disability group home (the 'communal daily life assistance' service under the Act on Comprehensive Support for Persons with Disabilities) rarely gets stuck on zoning. Under the Building Standards Act it is, in principle, treated as a 'dormitory', and dwellings, apartment houses and dormitories can be built in every use district except the exclusive industrial district (Appended Table 2). Where it gets stuck is: a change-of-use confirmation application when you convert a house or apartment and the converted floor area exceeds 200 sqm (Building Standards Act art. 87); whether fire equipment (sprinklers, automatic fire alarms) is required, which turns on whether it is item (6)-ro or (6)-ha under Appended Table 1 of the Fire Service Act Enforcement Order; and whether an existing building can meet the facility standards (each room at least 7.43 sqm excluding storage, etc.). Zoning checks and brokerage are real estate's; the designation application a certified administrative scrivener's; the change-of-use confirmation an architect's; the fire equipment the fire station's / a fire-equipment engineer's—each an independent business contracted with separately (no referral fees).

The key point: A property for a disability group home (the "communal daily life assistance" service under the Act on Comprehensive Support for Persons with Disabilities) rarely gets stuck on zoning. Under the Building Standards Act it is, in principle, treated as a "dormitory", and dwellings, apartment houses and dormitories can be built in every use district except the exclusive industrial district (Building Standards Act Appended Table 2); they can even be built in the strictest Category 1 low-rise exclusive residential district. What gets stuck is three points. First, if you convert an existing house or apartment and the converted floor area exceeds 200 square metres, a change-of-use confirmation application is required (Building Standards Act art. 87(1); under 200 sqm no application is needed, but the duty to comply with the fire and evacuation standards remains). Second, the need for fire equipment (sprinklers, automatic fire alarms) changes depending on whether it is a facility that mainly houses persons with disabilities who have difficulty evacuating—item (6)-ro of Appended Table 1 of the Fire Service Act Enforcement Order—or something else (item (6)-ha). Third, whether an existing building can meet the welfare-service facility standards (each room at least 7.43 sqm excluding storage; in principle one occupant, etc.). Confirming the location and zoning and brokering the lease/sale is real estate's (our) role; the designation application for the welfare service is a certified administrative scrivener's; the change-of-use confirmation for converting a house/apartment an architect's / the specified administrative agency's; the decision on fire equipment the competent fire station's / a fire-equipment engineer's. Registration is a judicial scrivener's and tax a tax accountant's field. These are each independent businesses contracted with separately (no referral or introduction fees are exchanged).

For operators and corporations searching for a property to open a disability group home (communal daily life assistance), this article organises what can be checked at the property-selection stage, in the order of the law and public materials. This is general information; the individual judgment on building, fire and designation standards rests with the specified administrative agency, the fire station and the designating authority (prefecture/city).

How does a disability group home differ from a dementia group home for the elderly?

The names resemble each other, but the governing law, the people served and the staffing standards are entirely different systems. Not confusing which one you are opening is the starting point.

Disability group home (this article)Dementia group home for the elderly
System nameCommunal daily life assistanceCommunal daily long-term care for dementia
Governing lawAct on Comprehensive Support for Persons with DisabilitiesLong-Term Care Insurance Act (community-based service)
People servedPersons with disabilitiesElderly with dementia needing support/care
Designating authorityPrefecture / designated city / core cityMunicipality

Communal daily life assistance is the service defined in art. 5 of the Act on Comprehensive Support for Persons with Disabilities—mainly at night, providing consultation, assistance with bathing, toileting, meals and other daily-life support in a residence for communal living (the definition sits in art. 5(17), but the paragraph number can shift with amendments, so check the latest on e-Gov Law Search). It is a separate system from the dementia group home covered in existing articles, so the way to look at the property is organised separately. For properties for housing for the elderly, see conditions for a property that can be a serviced elderly housing.

Which use districts allow it, and is the building a "dormitory" or an "apartment house"?

You hardly need to worry about zoning. A disability group home is, under the Building Standards Act, in principle treated as a "dormitory", and dormitories, apartment houses and dwellings can be built in every use district except the exclusive industrial district (Building Standards Act Appended Table 2). They can be built even in the strictest Category 1 low-rise exclusive residential district.

Use under the Building Standards ActTypical formZoning treatment
DormitoryRooms share living room, kitchen, bath, etc.Allowed except the exclusive industrial district (Appended Table 2)
Apartment houseEach unit has independent facilitiesAllowed except the exclusive industrial district
Detached houseUse of an existing house meeting certain requirementsSome municipalities do not treat it as a dormitory

In practice many group homes are treated as "dormitories". Some municipalities, however, provide an exception not to treat certain existing detached houses as dormitories, and the treatment differs by specified administrative agency. Which use it falls under changes the need for a change-of-use confirmation and the fire/evacuation rules. The actual judgment is the architect's / the specified administrative agency's.

How far are fire equipment (sprinklers, automatic fire alarms) required?

A disability group home is a fire-defence object falling under item (6) of Appended Table 1 of the Fire Service Act Enforcement Order. The issue is that within the same item (6), the requirement changes greatly between (6)-ro—"a facility that mainly houses persons with disabilities who have difficulty evacuating"—and (6)-ha (the rest).

CategoryRough guideSprinkler system
(6)-roA facility mainly housing persons with disabilities who have difficulty evacuating (one guide: whether those at disability support level 4 or higher exceed roughly 80%)In principle required regardless of total floor area (the amendment in force 1 April 2015 abolished the former 275-sqm-or-more area requirement)
(6)-haOther than (6)-roThe line for requirement/scale differs from (6)-ro

Even for (6)-ro, a small facility where those with evacuation difficulty are roughly 80% or less and whose total floor area is under 275 sqm may, if it meets certain structural requirements, fall within room not to require installation (an easing under the Fire Service Act Enforcement Regulations). Automatic fire alarms are often required even in a small (6) facility, and on top of this come a fire alarm device to notify the fire authority and, for 10 or more occupants, appointment of a fire-prevention manager (Fire Service Act art. 8). How far each piece of equipment is required varies with the building's scale, structure and occupants' condition, and the final decision is the competent fire station's / a fire-equipment engineer's field. At the pre-contract stage you confirm "which category it is likely to be" and "the current state of the existing fire equipment", then consult the fire station in advance. For another business where fire equipment is at issue, see a property for after-school day service for children with disabilities.

When converting an existing house or apartment, is a change-of-use confirmation application required?

Sometimes yes, sometimes no. The line is floor area. Building Standards Act art. 87(1) provides that where a building's use is changed into a special building under art. 6(1)(i) (a dormitory is a special building under item (2) of Appended Table 1) and the total floor area of the part serving that use exceeds 200 square metres, the confirmation-application provisions apply mutatis mutandis.

Converted floor area for the useChange-of-use confirmationNote
Over 200 sqmIn principle requiredA change between similar uses is excluded
200 sqm or lessNot requiredEven without an application, the duty to meet fire/evacuation standards remains

The 200-sqm figure was raised from the former "over 100 sqm" by the amendment in force on 25 June 2019. So even when converting a house into a dormitory, if the use part is 200 sqm or less no confirmation application is needed—but the need for a confirmation application and the need to comply with the standards are separate matters. Even without an application, it is essential to confirm whether the existing building meets the dormitory's fire, evacuation and lighting standards, and that is judged by the architect / specified administrative agency. At the property-selection stage, confirming the total floor area and the use-part area, the structure and number of storeys, and whether there is an existing inspection certificate makes the later steps less likely to stumble. The change-of-use confirmation application itself is an architect's work.

From property selection to the designation application, who handles what?

Opening a disability group home spans separate fields—the property (real estate), the designation application (certified administrative scrivener), the change-of-use confirmation (architect), fire equipment (fire station / fire-equipment engineer), registration (judicial scrivener) and tax (tax accountant). What a real-estate company handles is the property survey, the zoning check and the lease/sale brokerage; the rest goes to each, as an independent business contracted with separately.

TroubleWho to refer to
Location/zoning check, property survey, lease/sale brokerageUs (a real-estate transaction business)
Designation application for the welfare service (communal daily life assistance)Certified administrative scrivener
Change-of-use confirmation from a house/apartment, judgment on standards complianceArchitect / specified administrative agency
Decision on fire equipment such as sprinklers and automatic fire alarmsCompetent fire station / fire-equipment engineer
Lease and ownership-transfer registrationJudicial scrivener
Tax such as consumption and income taxTax accountant

These are each independent businesses, contracted with separately. We neither receive nor pay referral or introduction fees. Suitability under the designation standards is judged by the designating authority (prefecture/designated city/core city) and the certified administrative scrivener; the building's feasibility by the architect / specified administrative agency; the fire equipment by the fire station / fire-equipment engineer. We take consultations from organising the pre-contract points—whether a candidate property is not in the exclusive industrial district, the area and structure for using an existing building as a dormitory, and a rough read of the fire category. In your message, write "disability group home property" and include the intended location (municipality), whether it is a house, apartment or new build, the intended number of occupants and their condition (which bears on evacuation difficulty), and, for an existing building, the total floor area and whether there is an inspection certificate. Without presuming it is usable or not, we begin with organising the read on zoning, change-of-use and fire, and arranging which parts to refer to the designation, building and fire professionals.

Frequently asked questions

Q. Can a disability group home be opened in any use district?
A. In almost every use district. Under the Building Standards Act it is in principle treated as a "dormitory", and dormitories, apartment houses and dwellings can be built in every use district except the exclusive industrial district (Appended Table 2). They can be built even in the strictest Category 1 low-rise exclusive residential district. What gets stuck is not zoning but the three points of change-of-use confirmation, fire equipment and the facility standards. Which use it actually falls under is judged by the specified administrative agency.

Q. When renting a house to make a group home, is a change-of-use confirmation always required?
A. In principle it is required when the floor area of the part converted to a dormitory (a special building) exceeds 200 square metres (Building Standards Act art. 87(1)). At 200 sqm or less no confirmation application is needed, but even without an application the duty to comply with fire and evacuation standards remains. Confirming compliance and the confirmation application are the architect's / specified administrative agency's field.

Q. Must a sprinkler always be installed?
A. It depends on the occupants' condition. A facility mainly housing persons with disabilities who have difficulty evacuating (item (6)-ro of Appended Table 1 of the Fire Service Act Enforcement Order) must, under the amendment in force 1 April 2015 that abolished the area requirement, in principle install a sprinkler regardless of total floor area. However, a small facility where those with evacuation difficulty are roughly 80% or less and the total floor area is under 275 sqm may fall within room not to require it if it meets certain structural requirements. The final decision is the competent fire station's / a fire-equipment engineer's.

Q. Can I hire one company for everything from property search to the designation application?
A. The roles are split by the system. Property survey and brokerage are real estate's (ours); the designation application a certified administrative scrivener's; the change-of-use confirmation an architect's; fire equipment the fire station's / a fire-equipment engineer's field. We connect you as each an independent business contracted with separately, and exchange no referral fees. The window can be one while you contract directly with each professional.
