Spot work (gig jobs) is also fully covered by the Labor Standards Act if it is employment, even for single, short shifts. In many cases the labor contract forms at the moment of application, and the employer must disclose wages, working hours and other conditions (Labor Standards Act, Article 15, paragraph 1; Enforcement Regulation, Article 5; the April 1, 2024 amendment added the scope of change of workplace and duties). Workers' accident insurance applies to any worker regardless of form or hours, and the premium is borne entirely by the company. Employment and social insurance are judged by prescribed hours and the like, so a single day usually does not qualify. The minimum wage applies even for one hour, and if 8 hours a day or 40 a week is exceeded a 36 Agreement and premium pay are needed. Where the person works for other companies on the same day, hours are totaled across workplaces. This page covers condition disclosure, the insurances, premium pay and the minimum wage, totaling of hours, and who to ask for what.

In short: Spot work (gig jobs) is also fully covered by the Labor Standards Act so long as it is employment, even for single, short shifts. In many cases the labor contract forms at the moment of application (matching), and the employer must disclose wages, working hours and other conditions on concluding the contract (Labor Standards Act, Article 15, paragraph 1; Enforcement Regulation of the Labor Standards Act, Article 5 — the April 1, 2024 amendment added "the scope of change of the workplace and duties" and the like). Workers' accident insurance applies to any worker regardless of form or hours, and the premium is borne entirely by the company. Employment insurance and social insurance are judged by the prescribed working hours and the like, so a single day usually does not qualify. The minimum wage (Minimum Wage Act) applies even for one hour, and if 8 hours a day or 40 hours a week (Labor Standards Act, Article 32) is exceeded, a 36 Agreement (Article 36) and premium pay (Article 37) are required. Where the person also works for other companies on the same day, working hours are totaled even across different workplaces (Article 38, paragraph 1). From the viewpoint of a shakai hoken roumushi's labour management, this page covers condition disclosure, the application of the three insurances, premium pay and the minimum wage, the totaling of working hours, and who to ask for what — leaving dispute mediation to a specially-qualified roumushi or an attorney and wage-related tax to a tax accountant, under separate engagements with each as an independent business entity.

Spot work, in which single, short jobs are offered through hiring-intermediary apps and the worker is decided without an interview, is spreading. It is convenient for shops, facilities and sites that want to add hands only at busy times, but the misunderstanding that "a single shift has nothing to do with labour law" tends to lead to unpaid wages and missed accident-insurance procedures. This page is for managers and HR staff who use spot-work people, setting out the labour framework to grasp at the entrance, from the viewpoint of a shakai hoken roumushi's labour management.

Is condition disclosure required even for spot work (gig jobs)?

Yes. Spot work has no legal definition, but the Ministry of Health, Labour and Welfare treats it as single, short employment through hiring intermediaries, and where the worker is decided without an interview — for example on a first-come basis — the labor contract is considered to form at the moment the application (matching) is established. Because a labor contract forms, the employer must disclose wages, working hours and other conditions on concluding the contract (Labor Standards Act, Article 15, paragraph 1).

The items to disclose are set in Article 5 of the Enforcement Regulation, and the amendment effective April 1, 2024 (Ministry of Health, Labour and Welfare Ordinance No. 39 of 2023) added, for all workers, disclosure of "the scope of change of the workplace and of the duties to be performed." A job listing's content may serve as the disclosure, but if the conditions shown before application differ from the actual ones, disclosure must be made again. The method is in principle delivery of a document, and e-mail and the like is allowed if the worker so wishes. This is covered in the April 2024 change to condition-disclosure rules.

The hiring-intermediary app is not a party to the labor contract; the one who bears the duties under the Labor Standards Act is the employer doing the hiring. This point is also set out in a Ministry of Health, Labour and Welfare notice on securing labour conditions in spot work using hiring intermediaries (Kihatsu 0704 No. 3, July 4, 2025).

How do workers' accident, employment and social insurance apply, even for single, short work?

The thinking differs by insurance. Let us separate them at the entrance.

InsuranceApplication for single / short workBasis and points
Workers' accident insuranceApplies to any worker regardless of form or hours — even for one dayPremium borne entirely by the company. Injury during work or commuting is covered
Employment insuranceIn principle, enrolled where prescribed hours are 20 a week or more and continuous employment of 31 days or more is expected. A single day usually does not qualifyThere is a separate framework of a day-laborer insured person for those hired day by day (Employment Insurance Act, Articles 42 and 43)
Social insurance (health, pension)Judged by the three-quarters standard (weekly / monthly prescribed hours at three-quarters or more of a regular worker's) or the short-time rule of a specified workplace. Single / short work usually does not qualifyThere is a day-laborer special insured-person framework for those hired day by day

Workers' accident insurance applies to any worker regardless of nationality, form or hours, so even a single day of spot work is covered for injury during work or commuting. The premium is borne entirely by the company. Employment insurance has requirements such as 20 hours a week or more, so single shifts do not in principle make one an insured person (the lowering of the weekly-hours floor is covered in the 2028 expansion of employment insurance). The three-quarters standard and the short-time-worker rule of social insurance are set out in social insurance for short-time workers. Whether it applies in a given case is checked by a qualified professional against the latest requirements.

Do the 36 Agreement, premium pay and the minimum wage reach spot employment too?

They do. The Labor Standards Act applies fully to employment even if single and short.

ItemHandling in spot employment
Minimum wagePay at least the regional minimum wage of the prefecture of work, even for one hour (Minimum Wage Act, Article 4)
Statutory working hours8 hours a day and 40 a week are the ceiling (Labor Standards Act, Article 32). Even short work may exceed it through totaling with other companies
Overtime / holiday workIf you make them work beyond the statutory limit, a 36 Agreement must be concluded and filed (Article 36). The excess is premium pay (Article 37)
Late-night premiumWork between 22:00 and 05:00 carries a premium of 25% or more, even within prescribed hours (Article 37, paragraph 4)
Breaks45 minutes or more over 6 hours; 1 hour or more over 8 hours (Article 34)

Spot work often has a short single shift, so a 36 Agreement and overtime premiums may seem unlikely to arise. But late-night shifts, and the totaling of working hours described below, are situations where premiums and the 36 Agreement come in. Designing wages that build in rounding and the late-night premium is the point.

When the person also works for another company on the same day, how do you think about totaling working hours?

Working hours are, as a rule, totaled even across different workplaces (Labor Standards Act, Article 38, paragraph 1). In spot work, it is not unusual for a person to work for several companies on the same day. Even if the hours are short at each company, totaled they may exceed 8 hours a day, and then premium pay arises for the portion over statutory hours.

Under the thinking in the Ministry of Health, Labour and Welfare's guideline on promoting side and secondary work, prescribed hours are totaled by the order of the contracts, and the premium pay for the portion exceeding statutory hours by totaling is, as a rule, borne by the employer who concluded the labor contract later. In practice, the key is to have the person declare, on hiring, their planned work at other companies that day, and to confirm where your company stands in the order of contracts. This is covered in labour management of side and secondary work.

Note that where a person employed by several companies is injured, the daily benefit base for the accident-insurance payment is calculated by totaling the wages of all workplaces (Workers' Accident Compensation Insurance Act, Article 8, paragraph 3). This multiple-employer treatment is set out in workers' accident insurance for multiple-employer workers. Whether it applies is judged against the actual situation by a qualified professional.

Who do you ask for what (procedures, dispute mediation, tax)?

Keep the entrance of labour separate from the disputes and tax that follow. Condition disclosure, the procedures for acquiring and losing insured status under labour and social insurance, putting work rules and condition-notice templates in order, and designing a time-and-attendance system that builds in spot employment are the work of a shakai hoken roumushi. That is what this office handles.

On the other hand, representing a party in the mediation of an individual labour dispute — such as already-arisen unpaid wages — before a prefectural labour bureau or a labour commission is the work of a specially-qualified shakai hoken roumushi or an attorney (if this office does not hold the mediation-representation endorsement, we will guide you to an attorney). The tax side, such as calculating and paying the income tax withheld from wages, is the work of a tax accountant. We will guide you to contract with each as an independent business entity, separately, and this office does not accept referral fees.

Frequently asked questions

Q. Is condition disclosure required even for spot work (single-day jobs)?
A. Yes. Even single and short, if it is employment a labor contract forms, and the employer must disclose wages, working hours and other conditions on concluding it (Labor Standards Act, Article 15, paragraph 1; Enforcement Regulation, Article 5). Where the worker is decided without an interview on a first-come basis, the contract is considered to form at the moment of application, and the April 1, 2024 amendment added "the scope of change of the workplace and duties" to the items. A job listing may serve as the disclosure, but if the actual conditions differ it must be made again.

Q. Can workers' accident insurance be used even for a single day of work?
A. Yes. Workers' accident insurance applies to any worker regardless of form or hours, and even a single day covers injury during work or commuting. The premium is borne entirely by the company. By contrast, employment insurance in principle requires prescribed hours of 20 a week or more and expected continuous employment of 31 days or more, so a single day usually is not enrolled. Social insurance (health and pension) is also judged by the three-quarters standard and the like, so single / short work usually does not qualify. Check specific application against the latest requirements.

Q. If a spot-work person also works for another company on the same day, how do we think about overtime pay?
A. Working hours are totaled even across different workplaces (Labor Standards Act, Article 38, paragraph 1). Even if short at each company, totaled they may exceed 8 hours a day or 40 a week, and premium pay arises for the excess. Under the side-work guideline, the premium for the portion over statutory hours by totaling is, as a rule, borne by the employer who concluded the labor contract later. The practical key is to have the person declare that day's planned work at other companies on hiring, and to confirm where your company stands in the order.

Q. Do the minimum wage and the late-night premium apply to spot work?
A. They do. The minimum wage must be paid at least at the regional minimum of the prefecture of work, even for one hour (Minimum Wage Act, Article 4). Work between 22:00 and 05:00 needs a late-night premium of 25% or more even within prescribed hours (Labor Standards Act, Article 37, paragraph 4). Work over 6 hours also needs a break (Article 34). Being short does not exempt these.
