Child development support (preschool, multi-function): is the property decided by zoning and the development-support room?

For a property for child development support for preschool children with disabilities (Child Welfare Act art. 6-2-2(1),(2)), three things matter first: zoning (whether the facility counts as a 'child welfare facility, etc.' under Building Standards Act Enforcement Order art. 19(1)—a child development support centre does, so under Appended Table 2 it may be built in almost every zone except an exclusive industrial zone), the development-support room (the term used by the current designation standard; before the 2024 reform it was the 'guidance and training room'), and the fire-service category (a day-type service is in principle (6)-ha). The national standard sets no floor-area figure for an office-type facility (art. 9); only a centre (art. 10) must give 2.47 m² or more per child. We handle the check of zoning and structure and the brokerage; the designation application is an administrative scrivener's, staffing/labour a social insurance labour consultant's, and tax a tax accountant's, under separate, independent contracts.
The key point: For a property for child development support (jido-hattatsu-shien) for preschool children with disabilities (Child Welfare Act [Act No. 164 of 1947] art. 6-2-2(1) and (2)), three things matter first: (1) zoning—whether the facility counts as a "child welfare facility, etc." under Building Standards Act (Act No. 201 of 1950) Enforcement Order art. 19(1). A child development support centre is a child welfare facility under Child Welfare Act art. 7, so it qualifies and, under Appended Table 2, may be built in almost every zone except an exclusive industrial zone; (2) securing the development-support room (the term used by the current designation standard; before the 2024 reform it was the "guidance and training room"); (3) the fire-service category under the Fire Service Act Enforcement Order Appended Table 1 (a day-type child development service is in principle (6)-ha). The national standard (Standards on Staffing, Facilities and Operation for Designated Day Services under the Child Welfare Act [Ordinance of the Ministry of Health, Labour and Welfare No. 15 of 2012; now under the Children and Families Agency]) sets no floor-area figure for the room at an office-type facility (art. 9) and sets 2.47 m² or more per child only for a child development support centre (art. 10). We (a real-estate transaction business) handle the check of zoning and structure and the lease/sale brokerage; confirming conformity with the designation standard and the designation application are an administrative scrivener's, staffing of child instructors/nursery teachers and labour matters a social insurance labour consultant's, and the tax of rent/restoration a tax accountant's, each an independent business contracted with separately (no referral fees are exchanged).
For corporations and sole proprietors who want to start preschool child development support as a multi-function facility (run together with after-school day service and the like), this article organises how to look at a property, bearing in mind the difference from after-school day service for school-age children, in the order of the statutory text and local practice. This is general information; the final judgment on whether a particular property can obtain designation, and on the applicable category and area, rests with the designating authority (prefecture, ordinance-designated city or core city), the specified administrative agency, the competent fire station, and qualified professionals.

How far into the zoning categories can a child development support property go?
The Building Standards Act sets, in Appended Table 2, the buildings that may be built in each zone by use. A child development support facility is governed by whether it is a "child welfare facility, etc." under Enforcement Order art. 19(1).
A child development support centre is one of the child welfare facilities listed in Child Welfare Act art. 7. It therefore qualifies as a "child welfare facility, etc." and is treated like "nursing homes, nurseries, welfare homes and the like" in column (i) of Appended Table 2 (buildings allowed in a Category 1 low-rise exclusive residential zone). As a result it may be built in almost every zone except an exclusive industrial zone.
| Zone | Treatment of a child welfare facility, etc. (child development support centre, etc.) |
|---|---|
| Category 1/2 low-rise exclusive residential and other residential zones | May be built (Appended Table 2 column (i), etc.) |
| Neighbourhood commercial / commercial / quasi-industrial / industrial zones | May be built |
| Exclusive industrial zone | A child welfare facility, etc. may not be built |
| Nursery | Exceptionally may be built in all 13 zones (including an exclusive industrial zone) |
Note the office-type case (a designated child development support office other than a centre). Art. 19(1) expressly lists child welfare facilities and welfare-service businesses limited to daily-life care, independence training, transition support for employment, and continuous employment support; the business of child day services is not named in the text. Municipal regulations often treat the office type as a child welfare facility, etc. too, under column (i) item 6, but it is said that "the judgment is made according to the actual main function and form, not formally by name." If you change an existing office or shop into child development support, where the floor area of the use part exceeds 200 m², a change-of-use confirmation application (Building Standards Act art. 87(1)) may be required. Confirm zoning and the need for a change-of-use application with the specified administrative agency (building guidance section) for the planned site. We organise the points you can confirm before contracting from records and on site—zoning, the frontage road, the existing use and total floor area.
By what standard do you look at the development-support room's area, lighting and toilet?
The minimum facility standard is set by the Standards on Staffing, Facilities and Operation for Designated Day Services under the Child Welfare Act (Ordinance of the Ministry of Health, Labour and Welfare No. 15 of 2012; now under the Children and Families Agency). The current text uses the term "development-support room"; before the 2024 reform it was called the "guidance and training room."
| Type of facility | Governing article | Area standard for the development-support room |
|---|---|---|
| Designated child development support office (other than a centre) | Art. 9 | Must have a development-support room and the machines/equipment needed for support. No national floor-area figure |
| Designated child development support centre | Art. 10 | The development-support room has a capacity of about 10, with 2.47 m² or more of floor area per child. The playroom is 1.65 m² or more per child. Also an outdoor play area, infirmary, consultation room, kitchen, toilet, rest room, etc. |
So the national figure of 2.47 m² per person appears for a centre's development-support room; an office type has no national figure. That said, municipalities often add their own area standard by regulation (such as a minimum per child, or calculation by effective area), so the area actually required turns on the designating authority's standard. Lighting/ventilation and toilets/hand-washing may also be required by the Building Standards Act's rules for habitable rooms (lighting, etc.) and municipal facility standards. What we can confirm on the property side are facts: the effective area of the room to be used as the development-support room, ceiling height, whether there are windows, and the location and number of toilets/hand-washing. How many square metres you need, and whether that property can obtain designation, should be confirmed with the designating authority and an administrative scrivener.
Can you make it a multi-function facility in the same property as an after-school day service?
After-school day service (Child Welfare Act art. 6-2-2(3)) supports disabled children attending school, after class and on non-school days. Child development support (paragraph (2)) targets preschool children. Running both together in one office is the "multi-function" form.
Making it multi-function in the same property is possible in principle, but these differences matter when looking at a property. Preschool child development support is centred on the daytime, and school-age after-school day service on after-class/non-school days, so the same development-support room tends to be used in different time slots. Whether capacity is combined or divided, and how area and staffing are met, differ with the designating authority's regulations and practice. The flow line for pick-up and drop-off, parking/bicycle space, and safety for preschool children also need separate thought from a layout designed only for school-age after-school day service. Confirm the requirements for multi-function designation and the treatment of capacity with the administrative scrivener handling the designation application and with the designating authority. The first-floor-requirement view of school-age after-school day service is covered in another article. This article focuses on zoning and the development-support room when opening preschool child development support as a multi-function facility.
What do you confirm in the fire-service use category and notifications?
The Fire Service Act Enforcement Order Appended Table 1 classifies buildings by use and sets, by category, the fire-service equipment and fire management required. Welfare facilities fall in (6), and a day-type child day service (child development support/after-school day service) is in principle organised as (6)-ha.
| Category of Appended Table 1 | Character |
|---|---|
| (6)-ro | Facilities mainly for the residence/attendance of persons for whom self-evacuation is markedly difficult, etc. |
| (6)-ha | Other welfare facilities (day-type child day services, nurseries, etc.) |
However, depending on the condition of the children using the service, the competent fire station may judge it (6)-ro. The category changes the occupancy at which a fire manager must be appointed ((6)-ro from 10 persons, (6)-ha from 30 persons as a guide) and the fire-service equipment required. The need for automatic fire alarms, extinguishers and guide lights, and securing partitions and evacuation routes, is set by the property's scale and category. Confirm which category applies and what equipment is needed with the competent fire station and a fire-equipment officer. We organise the facts that underlie the category judgment—the property's number of floors, total floor area, evacuation routes and existing equipment.

Who do you assign designation, staffing and tax to, to move forward?
Opening child development support spans separate professional fields: surveying the property, confirming conformity with the designation standard and the designation application, staffing and labour, and rent/tax. What we handle is the check of the property's zoning, structure and fire category and the lease/sale brokerage; everything else we connect to each professional, each an independent business contracted with separately.
| Trouble | Who to ask |
|---|---|
| Checking the property's zoning, change-of-use and fire category; lease/sale brokerage | Us (a real-estate transaction business) |
| Confirming conformity with the designation standard; preparing the designation application | Administrative scrivener (the flow of designation applications for child development support / after-school day service (Japanese)) |
| Staffing of child instructors/nursery teachers; work rules; social insurance | Social insurance labour consultant (staffing standards and labour for child development support / after-school day service (Japanese)) |
| Accounting/tax of rent, interior work and restoration | Tax accountant |
| Individual judgment on the development-support room's area/equipment | Designating authority (prefecture / ordinance-designated city / core city) |
| Registration of ownership transfer, leasehold, etc. | Judicial scrivener |
These are each independent businesses, contracted with separately. We neither receive nor pay referral or introduction fees. Whether designation can be obtained is ultimately decided by the designating authority and the competent fire station checking the development-support room's area, staffing and fire category. Looking at the property, we take consultations from separating the issues—zoning, the development-support room, the fire category—and arranging where to confirm each. For finding a welfare-business property, see also the consultation desk for commercial/investment real estate (Japanese).
In your message, write "child development support property" and include whether you want it multi-function (together with after-school day service), the desired area, the floor area needed (a rough idea of capacity), and whether you want the first floor or an upper floor. Without presuming whether it can be obtained, we begin with checking zoning, the development-support room and the fire category, and arranging which parts to refer to professionals for designation, labour and tax.
Frequently asked questions
Q. How many square metres does a child development support property need?
A. The national ordinance sets a figure for a child development support centre's development-support room: 2.47 m² or more per child (capacity about 10) (Standards on Designated Day Services art. 10). An office type other than a centre has no national figure (art. 9); it must have a development-support room and the machines/equipment needed for support. But municipalities often add their own area standard by regulation, so the area actually needed should be confirmed with the designating authority (prefecture / ordinance-designated city / core city). We organise facts such as the property's effective area, ceiling height and number of rooms.
Q. Can child development support be done in a residential-district property?
A. Where the facility is a "child welfare facility, etc." under Building Standards Act Enforcement Order art. 19, it may, under Appended Table 2, be built in almost every zone except an exclusive industrial zone—including residential zones such as a Category 1 low-rise exclusive residential zone. A nursery may exceptionally be built in all 13 zones. But whether the office type is treated as a child welfare facility, etc. is judged by the specified administrative agency according to the actual form, not by name, so confirm with the building guidance section for the planned site.
Q. Can after-school day service and child development support be in the same property?
A. There is a "multi-function" form that runs both together, and doing so in the same property is possible in principle. But preschool child development support is centred on the daytime and school-age after-school day service on after-class/non-school days, so the development-support room tends to be used in different time slots. Whether capacity is combined or divided, and how area/staffing are met, differ with the designating authority's regulations and practice, so confirm with the administrative scrivener handling the designation application and with the designating authority.
Q. Will a real-estate company do the designation application for me?
A. No. Confirming conformity with the designation standard and preparing the designation application is an administrative scrivener's field, and staffing and labour a social insurance labour consultant's field; we do not do them. What we handle is the check of the property's zoning, change-of-use and fire category, and the lease/sale brokerage. This article is general information and does not guarantee that a particular property can obtain designation, so confirm the prospects with the designating authority and an administrative scrivener / social insurance labour consultant.
