What kind of property can become a designated driving school? Course, skills/classroom rooms, rest-room area and the zoning district

A property that can become a designated driving school is decided mainly by three things: the zoning district (a driving school can be built up to 3,000 sqm of floor area in a Category I Residential Zone, without limit from a Category II Residential Zone through Industrial Exclusive, and not at all in low-rise/mid-high-rise residential-exclusive and agricultural-residential zones — Table 2 of the Building Standards Act); the size of the course (as a rule 8,000 sqm or more under the Cabinet Office Ordinance on Designated Driving Schools, or 3,500 sqm for a school handling only large/ordinary motorcycle licences); and whether the building can hold classrooms, a waiting area, a rest room and toilets. Unlike a care-service office or a clinic, a driving-school property does not stumble on "the zoning district." It stumbles on whether a large piece of land for the course, plus a building for classrooms and the skills-training waiting/rest rooms, can all be secured on one site. "We found the building but the land for the course fell short"; "there was land, but no floor for a classroom" — notice these after signing and you redo the whole design. This is for those who want to open a new designated driving school (or a notified driving school for paper-licence refresher lessons) and are at the property-search stage, setting out what you can check before signing, from the Road Traffic Act, the Building Standards Act and the Cabinet Office Ordinance. The final check on whether it can be done is at the Prefectural Public Safety Commission (the driver's-licence section of the Prefectural Police Headquarters) with jurisdiction over the location.

Which zoning districts allow a designated driving school to be built?

A driving school is a building subject to zoning-district restrictions under the Building Standards Act. It cannot be built in the low-rise or mid-high-rise residential-exclusive zones or the agricultural-residential zone; it can be built up to 3,000 sqm of floor area in a Category I Residential Zone, and without limit from a Category II Residential Zone through the Industrial Exclusive Zone.

Under Article 48 and Table 2 of the Building Standards Act (Act No. 201 of 1950), whether a driving school can be built depends on the zoning district. Because the course land is large and buildings (a classroom block, a skills-training waiting area, garages) come with it, confirming the zoning district is the starting point for choosing land. Per the Ministry of Land, Infrastructure, Transport and Tourism's summary of use restrictions, it is roughly as follows.

Because the course land is large, Category II Residential / Quasi-residential and the quasi-industrial / industrial zones — where sizeable plots come up more readily — tend to be candidates, while in a Category I Residential Zone you must watch the 3,000 sqm cap on the building portion. In an urbanisation-control area the question of development permission (Article 29 of the City Planning Act) is layered on, so confirm the area classification of the site first. How large and what shape must the course (the driving track) be?

The course of a designated driving school needs as a rule 8,000 sqm or more (3,500 sqm or more for a school that handles only large/ordinary motorcycle skills-training and skills-testing). On top of that, tracks such as a circuit, a trunk road, a slope, a bend, a curve and a turning area must fit together on one contiguous piece of land.

The physical standards for a designated driving school are set, under Article 99, paragraph 1 of the Road Traffic Act, in the Cabinet Office Ordinance on Designated Driving Schools. The Ordinance puts the area of the course (the track used for skills-training and skills-testing) at as a rule 8,000 sqm or more (3,500 sqm or more for a school that conducts only large/ordinary motorcycle-licence skills-training and skills-testing) and specifies the types of track needed for ordinary-licence training. The key points when looking at land (the course) are as follows.

Because the figures and the details of the tracks are fixed by the Ordinance's standards and each Prefectural Public Safety Commission's review criteria and practice, at the land stage it is practical to first see "whether the required tracks can be laid out on one contiguous 8,000 sqm (3,500 sqm for motorcycles) site". Confirm the specific standards with the Public Safety Commission (Prefectural Police Headquarters) with jurisdiction.

What floor area and equipment do the classroom and the skills-training waiting/rest rooms need?

For classrooms, the law speaks of "an appropriate size and number according to the number of people receiving instruction," and no uniform floor area (how many sqm per person) is fixed in law. Alongside ancillary facilities such as a waiting area, a rest room and toilets, you look at whether the building side can secure them.

The Cabinet Office Ordinance on Designated Driving Schools requires that classrooms for lecture-based instruction be "of an appropriate size and number according to the number of people receiving instruction," so the requirement is to secure space and a number of rooms commensurate with the lecture attendance. Accordingly, this article does not state a specific figure for the per-person floor area of a classroom (because the law fixes no uniform figure). The specific floor area and number of rooms are judged by each Prefectural Public Safety Commission's review criteria and practice. What you can confirm when looking at a building is the following.

Because the specific area and number of rooms turn on the Public Safety Commission's review criteria, at the building stage it is safe to see "whether classrooms, a waiting area, an office and toilets commensurate with the assumed attendance can be laid out without strain," and confirm the appropriateness of the figures with the Public Safety Commission. How does the way you view a property differ between a notified driving school (paper-licence lessons) and a designated school?

Because a notified driving school has no system of skills-test exemption via skills-testing and a graduation certificate, it is not uniformly required to meet the course-area physical standard (8,000 sqm) of a designated school. On the other hand, if you aim for a designated school, you must choose from the outset a property that can hold both the course land and the classroom/waiting/rest rooms.

The Road Traffic Act distinguishes a "notified driving school" (Article 98, paragraph 2), whose operator notifies the Public Safety Commission, from a "designated driving school" (Article 99, paragraph 1), which the Public Safety Commission designates from among notified schools meeting the standards for staff, equipment and so on. Once designated, a graduate who passes the skills test is exempted from the skills test at the driver's-licence testing centre (Article 99-2). A notified school offering, say, paper-licence refresher lessons has no such skills-test exemption, so the level required of the property differs.

So if you aim to be designated later, even if you start as a notified school and switch to designation afterwards, keeping in view from the start land to which the course can be added and a building that can serve as a classroom cuts down on rework.
