What are the property requirements for a certified auto workshop (specified-maintenance certification)?

A property usable as a certified auto workshop (specified maintenance, Article 78 of the Road Transport Vehicle Act) turns on three things — whether the use-zone allows an auto repair shop, whether the certification-standard work bays fit with enough width and ceiling height, and whether the floor and frontage road can take lift work and the vehicles. All can be checked before you sign. A licensed real estate agent and administrative scrivener in Bunkyo, Tokyo, sets out what to confirm before the lease.

In short: a property usable as a certified auto workshop (specified maintenance, Article 78 of the Road Transport Vehicle Act) is decided by three points — (1) whether the use-zone allows an auto repair shop, (2) whether the certification-standard work bay and inspection bay (Article 80) fit with enough width and ceiling height, and (3) whether the floor and frontage road can take lift work and the vehicles. All can be confirmed before the lease is signed.

A "certified workshop" that carries out disassembly maintenance and electronic-control-device maintenance cannot open without the certification of the District Transport Bureau Director. And the certification is granted only once the size, equipment and people meet the standards. "We leased the property, then applied for certification and the bay was too small" — the same rework that hits care facilities and clinics hits auto workshops too. What floor area and ceiling height does a certified specified-maintenance workshop need?

It varies with the class of vehicle handled, but for passenger ordinary vehicles and four-wheel light-standard vehicles you need room for the indoor work area (the vehicle work bay and inspection bay), the parts work area and the vehicle storage area together.

Anyone intending to run a specified-maintenance business must, under Article 78, paragraph 1 of the Road Transport Vehicle Act (Act No. 185 of 1951), obtain the certification of the District Transport Bureau Director. The standards for certification are set in Article 80 and the Enforcement Regulation, and the scale of the work areas is fixed in the Regulation's tables by class of vehicle. For passenger ordinary and four-wheel light-standard vehicles, the rough guide is as follows.

For large vehicles (gross weight 8t+, etc.) the figures grow, with the vehicle work bay around width 5m+ × depth 13m+. The ceiling must be high enough to do lift work on the target vehicle, and the floor must be smoothly paved. If you do electronic-control-device maintenance (below), you also need an electronic-control-device inspection-and-maintenance area, but it may be shared with the vehicle work bay and inspection bay. Are there places, by use-zone or surroundings, where an auto workshop cannot open?

Yes. An auto repair shop is subject to the use-zone restrictions of the Building Standards Act and cannot be built in many residential zones.

Clinics and nurseries do not get stuck on use-zone, but auto repair shops do. Article 48 and Table 2 of the Building Standards Act (Act No. 201 of 1950) divide the zones where an auto repair shop may be built by the total floor area of the work area. Per the MLIT summary of use restrictions, it is roughly as follows.

The point to watch is that the "work area" size in the certification standard and the "work-area floor area" in the use-zone restriction are different rulers. Secure a large indoor work area to obtain certification, and its floor area may exceed the use-zone ceiling (150㎡ in quasi-residential), so it cannot be built there. How do property requirements differ between a certified workshop and a designated workshop (private inspection station)?

A designated workshop needs, on top of the certified-workshop requirements, a "completion inspection bay" and inspection machinery. The property is larger and the equipment burden heavier.

A certified workshop brings the maintained vehicle to the Transport Branch Office's inspection lane. A designated workshop (private inspection station, Article 94-2 of the Act) is a certified workshop that also holds the inspection equipment and an automobile inspector and can issue a safety-standard conformity certificate. In exchange for skipping the drive-in, the property requirements grow.

The usual order is to choose the property as a certified workshop first, then aim for a designated workshop (private inspection station) once the business grows. When getting certification on a leased property, what should you confirm with the landlord before signing?

Confirm "may I use it for this purpose" and "will the building take the work and heavy equipment" in writing, before signing.

To open a certified workshop on a lease, look at both the contract and the current condition. The key checks are these.

Who handles the property-requirement check and who the certification application?

The property (real estate) and the certification (administrative procedure) are handled by different parties.

Launching a certified workshop splits into finding and contracting the property, and obtaining certification. Whether the people (maintenance supervisor, workers) and equipment meet the standard is examined within the certification application, so fix the property first and you may find it fails and has to be redone — which is why the points above are laid out before signing. Q. When is specified-maintenance certification needed?
A. When you carry out, as a business, work amounting to "specified maintenance" under Article 49, paragraph 2 of the Road Transport Vehicle Act. Besides the traditional disassembly maintenance (maintenance involving disassembly of the engine, power-transmission, running, steering, braking, buffer and coupling devices), the amendment in force 1 April 2020 added "electronic-control-device maintenance" — removing and calibrating (aiming) the cameras and radar of automated driving devices and collision-damage-mitigation brakes. Whether it applies varies by the work, so confirm with the Transport Branch Office before you start.

Q. Besides the work area, how many mechanics does certification need?
A. Including the maintenance supervisor, two or more employees engaged in specified maintenance are required. A set proportion must be qualified automobile mechanics — as a guide, 1 for 2–4 workers, 2 for 5–8, 3 for 9–12. The maintenance supervisor is in principle appointed from Class 1 or Class 2 automobile mechanics (excluding Class 2 chassis mechanics where the engine is a target). Confirm the human requirements with the Transport Branch Office.

Q. Can I lease an empty warehouse in a residential district and make it a workshop?
A. It depends on the use-zone. An auto repair shop may be built only in limited zones under Table 2 of the Building Standards Act, and not in Cat. 1/2 low-rise or residential-exclusive zones. As a guide, quasi-residential allows total work-area floor area ≤150㎡, neighbourhood commercial/commercial/quasi-industrial ≤300㎡, and industrial/exclusive-industrial no limit. A use-change from a warehouse may need a building-confirmation application. Confirm the zone and the building's history before signing.
